9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 39.025(f), Education Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | (f) The commissioner shall by rule adopt a transition plan |
---|
13 | 13 | | to implement the amendments made by Chapter 1312 (S.B. No. 1031), |
---|
14 | 14 | | Acts of the 80th Legislature, Regular Session, 2007, to this |
---|
15 | 15 | | section and Sections 39.023(a) and (c) and 39.051(b)(5). The rules |
---|
16 | 16 | | must provide for the end-of-course assessment instruments adopted |
---|
17 | 17 | | under Section 39.023(c) to be administered beginning with students |
---|
18 | 18 | | entering the ninth grade during the 2011-2012 school year. During |
---|
19 | 19 | | the period under which the transition to end-of-course assessment |
---|
20 | 20 | | instruments is made: |
---|
21 | 21 | | (1) for students entering a grade above the ninth |
---|
22 | 22 | | grade during the 2011-2012 school year: |
---|
23 | 23 | | (A) [,] the commissioner shall retain, |
---|
24 | 24 | | administer, and use for campus and district ratings under |
---|
25 | 25 | | Subchapter D the assessment instruments required by Section |
---|
26 | 26 | | 39.023(a) or (c), as that section existed before amendment by |
---|
27 | 27 | | Chapter 1312 (S.B. No. 1031), Acts of the 80th Legislature, Regular |
---|
28 | 28 | | Session, 2007; and |
---|
29 | 29 | | (B) notwithstanding any other provision of this |
---|
30 | 30 | | chapter, for any purpose under this chapter, each student is |
---|
31 | 31 | | required only to achieve a cumulative score on the exit-level |
---|
32 | 32 | | assessment instruments administered under Section 39.023(c), as |
---|
33 | 33 | | that section existed before amendment by Chapter 1312 (S.B. No. |
---|
34 | 34 | | 1031), Acts of the 80th Legislature, Regular Session, 2007, that is |
---|
35 | 35 | | at least equal to the product of the number of exit-level assessment |
---|
36 | 36 | | instruments administered under the section before the amendment and |
---|
37 | 37 | | 70, with each exit-level assessment instrument scored on a scale of |
---|
38 | 38 | | 100; and |
---|
39 | 39 | | (2) the agency may defer releasing assessment |
---|
40 | 40 | | instrument questions and answer keys as required by Section |
---|
41 | 41 | | 39.023(e) to the extent necessary to develop additional assessment |
---|
42 | 42 | | instruments. |
---|
43 | 43 | | SECTION 2. This Act takes effect immediately if it receives |
---|
44 | 44 | | a vote of two-thirds of all the members elected to each house, as |
---|
45 | 45 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
46 | 46 | | Act does not receive the vote necessary for immediate effect, this |
---|
47 | 47 | | Act takes effect September 1, 2009. |
