66 AN ACT
77 relating to scoring the state exit-level assessment instruments
88 administered to public school students.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 39.025(f), Education Code, is amended to
1111 read as follows:
1212 (f) The commissioner shall by rule adopt a transition plan
1313 to implement the amendments made by Chapter 1312 (S.B. No. 1031),
1414 Acts of the 80th Legislature, Regular Session, 2007, to this
1515 section and Sections 39.023(a) and (c) and 39.051(b)(5). The rules
1616 must provide for the end-of-course assessment instruments adopted
1717 under Section 39.023(c) to be administered beginning with students
1818 entering the ninth grade during the 2011-2012 school year. During
1919 the period under which the transition to end-of-course assessment
2020 instruments is made:
2121 (1) for students entering a grade above the ninth
2222 grade during the 2011-2012 school year:
2323 (A) [,] the commissioner shall retain,
2424 administer, and use for campus and district ratings under
2525 Subchapter D the assessment instruments required by Section
2626 39.023(a) or (c), as that section existed before amendment by
2727 Chapter 1312 (S.B. No. 1031), Acts of the 80th Legislature, Regular
2828 Session, 2007; and
2929 (B) notwithstanding any other provision of this
3030 chapter, for any purpose under this chapter, each student is
3131 required only to achieve a cumulative score on the exit-level
3232 assessment instruments administered under Section 39.023(c), as
3333 that section existed before amendment by Chapter 1312 (S.B. No.
3434 1031), Acts of the 80th Legislature, Regular Session, 2007, that is
3535 at least equal to the product of the number of exit-level assessment
3636 instruments administered under the section before the amendment and
3737 70, with each exit-level assessment instrument scored on a scale of
3838 100; and
3939 (2) the agency may defer releasing assessment
4040 instrument questions and answer keys as required by Section
4141 39.023(e) to the extent necessary to develop additional assessment
4242 instruments.
4343 SECTION 2. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2009.
