55 relating to the regulation of certain consumer transactions
66 involving plumbing, air conditioning, and electrical services.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter A, Chapter 1301, Occupations Code, is
99 amended by adding Section 1301.004 to read as follows:
1010 Sec. 1301.004. NONAPPLICABILITY OF LAW GOVERNING
1111 CANCELLATION OF CERTAIN TRANSACTIONS. Except as otherwise provided
1212 by this section, Chapter 601, Business & Commerce Code, does not
1313 apply to a good or service provided by a license holder under this
1414 chapter if the transaction involving the good or service is
1515 initiated by the consumer. Chapter 601, Business & Commerce Code,
1616 does apply to a transaction that involves a breach of express
1717 warranty or a negligent installation in violation of a building
1818 code applicable to the good or service sold to the consumer.
1919 SECTION 2. Subchapter A, Chapter 1302, Occupations Code, is
2020 amended by adding Section 1302.003 to read as follows:
2121 Sec. 1302.003. NONAPPLICABILITY OF LAW GOVERNING
2222 CANCELLATION OF CERTAIN TRANSACTIONS. Except as otherwise provided
2323 by this section, Chapter 601, Business & Commerce Code, does not
2424 apply to a good or service provided by a license holder under this
2525 chapter if the transaction involving the good or service is
2626 initiated by the consumer. Chapter 601, Business & Commerce Code,
2727 does apply to a transaction that involves a breach of express
2828 warranty or a negligent installation in violation of a building
2929 code applicable to the good or service sold to the consumer.
3030 SECTION 3. Subchapter A, Chapter 1305, Occupations Code, is
3131 amended by adding Section 1305.004 to read as follows:
3232 Sec. 1305.004. NONAPPLICABILITY OF LAW GOVERNING
3333 CANCELLATION OF CERTAIN TRANSACTIONS. Except as otherwise provided
3434 by this section, Chapter 601, Business & Commerce Code, does not
3535 apply to a good or service provided by a license holder under this
3636 chapter if the transaction involving the good or service is
3737 initiated by the consumer. Chapter 601, Business & Commerce Code,
3838 does apply to a transaction that involves a breach of express
3939 warranty or a negligent installation in violation of a building
4040 code applicable to the good or service sold to the consumer.
4141 SECTION 4. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2009.
