55 relating to authorizing the transfer of certain abandoned or
66 forfeited property to groundwater conservation districts.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Articles 59.06(b) and (b-2), Code of Criminal
99 Procedure, are amended to read as follows:
1010 (b) If a local agreement exists between the attorney
1111 representing the state and law enforcement agencies, the attorney
1212 representing the state may transfer the property to law enforcement
1313 agencies to maintain, repair, use, and operate the property for
1414 official purposes if the property is free of any interest of an
1515 interest holder. The agency receiving the forfeited property may
1616 purchase the interest of an interest holder so that the property can
1717 be released for use by the agency. The agency receiving the
1818 forfeited property may maintain, repair, use, and operate the
1919 property with money appropriated for current operations. If the
2020 property is a motor vehicle subject to registration under the motor
2121 vehicle registration laws of this state, the agency receiving the
2222 forfeited vehicle is considered to be the purchaser and the
2323 certificate of title shall issue to the agency. A law enforcement
2424 agency to which property is transferred under this subsection at
2525 any time may transfer or loan the property to any other municipal or
2626 county agency, a groundwater conservation district governed by
2727 Chapter 36, Water Code, or [to] a school district for the use of
2828 that agency or district. A municipal or county agency, a
2929 groundwater conservation district, or a school district to which a
3030 law enforcement agency loans a motor vehicle under this subsection
3131 shall maintain any automobile insurance coverage for the vehicle
3232 that is required by law.
3333 (b-2) An agency that loans property under this article
3434 shall:
3535 (1) keep a record of the loan, including the name of
3636 the agency or district to which the vehicle was loaned, the fair
3737 market value of the vehicle, and where the receiving agency or
3838 district will use the vehicle; and
3939 (2) update the record when the information relating to
4040 the vehicle changes.
4141 SECTION 2. Sections 683.016(a) and (b), Transportation
4242 Code, are amended to read as follows:
4343 (a) The law enforcement agency that takes an abandoned motor
4444 vehicle into custody that is not claimed under Section 683.012 may:
4545 (1) use the vehicle for agency purposes; or
4646 (2) transfer the vehicle to any other municipal or
4747 county agency, a groundwater conservation district governed by
4848 Chapter 36, Water Code, or a school district for the use of that
4949 agency or district.
5050 (b) The law enforcement agency shall auction the vehicle as
5151 provided by this subchapter if the law enforcement agency or the
5252 municipal or county agency, groundwater conservation district, or
5353 school district to which the vehicle was transferred under
5454 Subsection (a) discontinues use of the vehicle.
5555 SECTION 3. Article 59.06, Code of Criminal Procedure, and
5656 Section 683.016, Transportation Code, as amended by this Act, apply
5757 to personal property seized or taken into custody on or after the
5858 effective date of this Act. Personal property seized or taken into
5959 custody before the effective date of this Act is governed by the law
6060 in effect on the date the property is seized or taken into custody,
6161 and the former law is continued in effect for that purpose.
6262 SECTION 4. This Act takes effect September 1, 2009.
