77 relating to the development of a long-range state low income
88 housing plan.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 2306, Government Code, is
1111 amended by adding Section 2306.0725 to read as follows:
1212 Sec. 2306.0725. LONG-RANGE LOW INCOME HOUSING PLAN.
1313 (a) The director shall prepare and submit to the board an
1414 integrated long-range state low income housing plan covering at
1515 least six years.
1616 (b) Not later than the 30th day after the date the board
1717 receives and approves the plan, the board shall submit the plan to
1818 the governor, the lieutenant governor, and the speaker of the house
1919 of representatives.
2020 (c) The plan must establish policy goals for meeting low
2121 income housing needs on a statewide and regional basis and
2222 prescribe strategies to meet those goals. The plan must include:
2323 (1) an estimate and analysis of the housing needs of
2424 the following populations in each uniform state service region:
2525 (A) individuals and families of moderate, low,
2626 very low, and extremely low income;
2727 (B) individuals with special needs, with
2828 specific emphasis on the needs of elderly individuals and
2929 individuals with disabilities; and
3030 (C) homeless individuals;
3131 (2) a proposal to use all available housing resources
3232 to address the housing needs of the populations described by
3333 Subdivision (1) by establishing funding levels for all
3434 housing-related programs;
3535 (3) an estimate of the number of federally assisted
3636 housing units available for individuals and families of low and
3737 very low income and individuals with special needs in each uniform
3838 state service region;
3939 (4) a description of state programs that govern the
4040 use of all available housing resources;
4141 (5) a resource allocation plan that targets all
4242 available housing resources to individuals and families of low and
4343 very low income and individuals with special needs in each uniform
4444 state service region;
4545 (6) a description of the department's efforts to
4646 monitor and analyze the unused or underused federal resources of
4747 other state agencies for housing-related services and services for
4848 homeless individuals and the department's recommendations to
4949 ensure the full use by the state of all available federal resources
5050 for those services in each uniform state service region;
5151 (7) strategies to provide housing for individuals and
5252 families with special needs in each uniform state service region;
5353 (8) a description of the department's efforts to
5454 encourage in each uniform state service region the construction of
5555 housing units that incorporate energy efficient construction and
5656 appliances;
5757 (9) an estimate and analysis of the housing supply in
5858 each uniform state service region;
5959 (10) an inventory of all publicly and, where possible,
6060 privately funded housing resources, including public housing
6161 authorities, housing finance corporations, community housing
6262 development organizations, and community action agencies;
6363 (11) strategies for meeting rural housing needs;
6464 (12) an action plan for colonias that addresses
6565 current policy goals for colonia programs, strategies to meet the
6666 policy goals, and the projected outcomes with respect to the policy
6767 goals; and
6868 (13) strategies for eliminating redundant and
6969 inefficient practices.
7070 (d) The priorities and policies in each housing plan adopted
7171 by the department must be consistent to the extent practical with
7272 the priorities and policies established in the long-range state low
7373 income housing plan.
7474 (e) The director may subdivide the uniform state service
7575 regions as necessary for purposes of the long-range state low
7676 income housing plan.
7777 SECTION 2. The executive director of the Texas Department
7878 of Housing and Community Affairs shall submit to the governing
7979 board of the department the first long-range state low income
8080 housing plan, as required by Section 2306.0725, Government Code, as
8181 added by this Act, not later than March 18, 2010.
8282 SECTION 3. This Act takes effect September 1, 2009.
