7 | 7 | | relating to the development of a long-range state low income |

8 | 8 | | housing plan. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter D, Chapter 2306, Government Code, is |
---|
11 | 11 | | amended by adding Section 2306.0725 to read as follows: |
---|
12 | 12 | | Sec. 2306.0725. LONG-RANGE LOW INCOME HOUSING PLAN. |
---|
13 | 13 | | (a) The director shall prepare and submit to the board an |
---|
14 | 14 | | integrated long-range state low income housing plan covering at |
---|
15 | 15 | | least six years. |
---|
16 | 16 | | (b) Not later than the 30th day after the date the board |
---|
17 | 17 | | receives and approves the plan, the board shall submit the plan to |
---|
18 | 18 | | the governor, the lieutenant governor, and the speaker of the house |
---|
19 | 19 | | of representatives. |
---|
20 | 20 | | (c) The plan must establish policy goals for meeting low |
---|
21 | 21 | | income housing needs on a statewide and regional basis and |
---|
22 | 22 | | prescribe strategies to meet those goals. The plan must include: |
---|
23 | 23 | | (1) an estimate and analysis of the housing needs of |
---|
24 | 24 | | the following populations in each uniform state service region: |
---|
25 | 25 | | (A) individuals and families of moderate, low, |
---|
26 | 26 | | very low, and extremely low income; |
---|
27 | 27 | | (B) individuals with special needs, with |
---|
28 | 28 | | specific emphasis on the needs of elderly individuals and |
---|
29 | 29 | | individuals with disabilities; and |
---|
30 | 30 | | (C) homeless individuals; |
---|
31 | 31 | | (2) a proposal to use all available housing resources |
---|
32 | 32 | | to address the housing needs of the populations described by |
---|
33 | 33 | | Subdivision (1) by establishing funding levels for all |
---|
34 | 34 | | housing-related programs; |
---|
35 | 35 | | (3) an estimate of the number of federally assisted |
---|
36 | 36 | | housing units available for individuals and families of low and |
---|
37 | 37 | | very low income and individuals with special needs in each uniform |
---|
38 | 38 | | state service region; |
---|
39 | 39 | | (4) a description of state programs that govern the |
---|
40 | 40 | | use of all available housing resources; |
---|
41 | 41 | | (5) a resource allocation plan that targets all |
---|
42 | 42 | | available housing resources to individuals and families of low and |
---|
43 | 43 | | very low income and individuals with special needs in each uniform |
---|
44 | 44 | | state service region; |
---|
45 | 45 | | (6) a description of the department's efforts to |
---|
46 | 46 | | monitor and analyze the unused or underused federal resources of |
---|
47 | 47 | | other state agencies for housing-related services and services for |
---|
48 | 48 | | homeless individuals and the department's recommendations to |
---|
49 | 49 | | ensure the full use by the state of all available federal resources |
---|
50 | 50 | | for those services in each uniform state service region; |
---|
51 | 51 | | (7) strategies to provide housing for individuals and |
---|
52 | 52 | | families with special needs in each uniform state service region; |
---|
53 | 53 | | (8) a description of the department's efforts to |
---|
54 | 54 | | encourage in each uniform state service region the construction of |
---|
55 | 55 | | housing units that incorporate energy efficient construction and |
---|
56 | 56 | | appliances; |
---|
57 | 57 | | (9) an estimate and analysis of the housing supply in |
---|
58 | 58 | | each uniform state service region; |
---|
59 | 59 | | (10) an inventory of all publicly and, where possible, |
---|
60 | 60 | | privately funded housing resources, including public housing |
---|
61 | 61 | | authorities, housing finance corporations, community housing |
---|
62 | 62 | | development organizations, and community action agencies; |
---|
63 | 63 | | (11) strategies for meeting rural housing needs; |
---|
64 | 64 | | (12) an action plan for colonias that addresses |
---|
65 | 65 | | current policy goals for colonia programs, strategies to meet the |
---|
66 | 66 | | policy goals, and the projected outcomes with respect to the policy |
---|
67 | 67 | | goals; and |
---|
68 | 68 | | (13) strategies for eliminating redundant and |
---|
69 | 69 | | inefficient practices. |
---|
70 | 70 | | (d) The priorities and policies in each housing plan adopted |
---|
71 | 71 | | by the department must be consistent to the extent practical with |
---|
72 | 72 | | the priorities and policies established in the long-range state low |
---|
73 | 73 | | income housing plan. |
---|
74 | 74 | | (e) The director may subdivide the uniform state service |
---|
75 | 75 | | regions as necessary for purposes of the long-range state low |
---|
76 | 76 | | income housing plan. |
---|
77 | 77 | | SECTION 2. The executive director of the Texas Department |
---|
78 | 78 | | of Housing and Community Affairs shall submit to the governing |
---|
79 | 79 | | board of the department the first long-range state low income |
---|
80 | 80 | | housing plan, as required by Section 2306.0725, Government Code, as |
---|
81 | 81 | | added by this Act, not later than March 18, 2010. |
---|
82 | 82 | | SECTION 3. This Act takes effect September 1, 2009. |
