O'Brien, Director, Legislative Budget Board IN RE:HB3181 by Thompson (Relating to authorizing injunctive relief during proceedings to cancel or suspend certain alcoholic beverage permits and licenses.), As Engrossed No significant fiscal implication to the State is anticipated. The bill would give the Texas Alcoholic Beverage Commission (TABC) authority to seek injunctive relief to stop the sale of alcoholic beverages on licensed premises where there are ongoing criminal acts occurring that constitute a threat to the public health, safety, or welfare. TABC would file a motion with the State Office of Administrative Hearings (SOAH), and if it established the ongoing criminal acts, the SOAH Administrative Law Judge would issue an injunction under certain circumstances. The bill would take effect September 1, 2009. The SOAH believes that it could absorb any additional work associated with the bill without significant impact to its resources.
