A BILL TO BE ENTITLED
AN ACT
relating to ballot language for a proposition to approve the
imposition or increase of a tax or the issuance of bonds.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 52.072, Election Code, is amended by
adding Subsection (e) to read as follows:
(e) In addition to any other requirement imposed by law for
a proposition, including a provision prescribing the proposition
language, a proposition allowing the voters to approve the
imposition or increase of a tax or the issuance of bonds shall
specifically state:
(1) as applicable:
(A) the total dollar amount of bonds that will be
issued; or
(B) the amount of the tax or tax rate increase;
and
(2) in plain language, any projects to be supported by
the bonds.
SECTION 2. The change in law made by this Act applies only
to an election ordered on or after the effective date of this Act.
An election ordered before the effective date of this Act is
governed by the law in effect when the election was ordered, and the
former law is continued in effect for that purpose.
SECTION 3. This Act takes effect September 1, 2009.
