9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 23, Property Code, is amended by adding | |
11 | 11 | Section 23.0051 to read as follows: | |
12 | 12 | Sec. 23.0051. ATTORNEY'S FEES. In an action in which real | |
13 | 13 | property is partitioned by sale, the court may award attorney's | |
14 | 14 | fees to the person who filed the action if the person's attorney | |
15 | 15 | demonstrates that the attorney's work benefited the person who | |
16 | 16 | filed the action and the other parties to the action. | |
17 | 17 | SECTION 2. The change in law made by this Act applies only | |
18 | 18 | to an action commenced on or after the effective date of this Act. | |
19 | 19 | An action commenced before the effective date of this Act is | |
20 | 20 | governed by the law in effect immediately before the effective date | |
21 | 21 | of this Act, and that law is continued in effect for that purpose. | |
22 | 22 | SECTION 3. This Act takes effect September 1, 2009. |
