5	5	relating to the designation of certain fire marshals and related
6	6	officers, inspectors, and investigators as peace officers.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Article 2.12, Code of Criminal Procedure, is
9	9	amended to read as follows:
10	10	Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace
11	11	officers:
12	12	(1) sheriffs, their deputies, and those reserve
13	13	deputies who hold a permanent peace officer license issued under
14	14	Chapter 1701, Occupations Code;
15	15	(2) constables, deputy constables, and those reserve
16	16	deputy constables who hold a permanent peace officer license issued
17	17	under Chapter 1701, Occupations Code;
18	18	(3) marshals or police officers of an incorporated
19	19	city, town, or village, and those reserve municipal police officers
20	20	who hold a permanent peace officer license issued under Chapter
21	21	1701, Occupations Code;
22	22	(4) rangers and officers commissioned by the Public
23	23	Safety Commission and the Director of the Department of Public
24	24	Safety;
25	25	(5) investigators of the district attorneys', criminal
26	26	district attorneys', and county attorneys' offices;
27	27	(6) law enforcement agents of the Texas Alcoholic
28	28	Beverage Commission;
29	29	(7) each member of an arson investigating unit
30	30	commissioned by a city, a county, or the state;
31	31	(8) officers commissioned under Section 37.081,
32	32	Education Code, or Subchapter E, Chapter 51, Education Code;
33	33	(9) officers commissioned by the General Services
34	34	Commission;
35	35	(10) law enforcement officers commissioned by the
36	36	Parks and Wildlife Commission;
37	37	(11) airport police officers commissioned by a city
38	38	with a population of more than 1.18 million that operates an airport
39	39	that serves commercial air carriers;
40	40	(12) airport security personnel commissioned as peace
41	41	officers by the governing body of any political subdivision of this
42	42	state, other than a city described by Subdivision (11), that
43	43	operates an airport that serves commercial air carriers;
44	44	(13) municipal park and recreational patrolmen and
45	45	security officers;
46	46	(14) security officers and investigators commissioned
47	47	as peace officers by the comptroller;
48	48	(15) officers commissioned by a water control and
49	49	improvement district under Section 49.216, Water Code;
50	50	(16) officers commissioned by a board of trustees
51	51	under Chapter 54, Transportation Code;
52	52	(17) investigators commissioned by the Texas Medical
53	53	Board;
54	54	(18) officers commissioned by the board of managers of
55	55	the Dallas County Hospital District, the Tarrant County Hospital
56	56	District, or the Bexar County Hospital District under Section
57	57	281.057, Health and Safety Code;
58	58	(19) county park rangers commissioned under
59	59	Subchapter E, Chapter 351, Local Government Code;
60	60	(20) investigators employed by the Texas Racing
61	61	Commission;
62	62	(21) officers commissioned under Chapter 554,
63	63	Occupations Code;
64	64	(22) officers commissioned by the governing body of a
65	65	metropolitan rapid transit authority under Section 451.108,
66	66	Transportation Code, or by a regional transportation authority
67	67	under Section 452.110, Transportation Code;
68	68	(23) investigators commissioned by the attorney
69	69	general under Section 402.009, Government Code;
70	70	(24) security officers and investigators commissioned
71	71	as peace officers under Chapter 466, Government Code;
72	72	(25) an officer employed by the Department of State
73	73	Health Services under Section 431.2471, Health and Safety Code;
74	74	(26) officers appointed by an appellate court under
75	75	Subchapter F, Chapter 53, Government Code;
76	76	(27) officers commissioned by the state fire marshal
77	77	under Chapter 417, Government Code;
78	78	(28) an investigator commissioned by the commissioner
79	79	of insurance under Section 701.104, Insurance Code;
80	80	(29) apprehension specialists and inspectors general
81	81	commissioned by the Texas Youth Commission as officers under
82	82	Sections 61.0451 and 61.0931, Human Resources Code;
83	83	(30) officers appointed by the inspector general of
84	84	the Texas Department of Criminal Justice under Section 493.019,
85	85	Government Code;
86	86	(31) investigators commissioned by the Commission on
87	87	Law Enforcement Officer Standards and Education under Section
88	88	1701.160, Occupations Code;
89	89	(32) commission investigators commissioned by the
90	90	Texas Private Security Board under Section 1702.061(f),
91	91	Occupations Code;
92	92	(33) the fire marshal and any officers, inspectors, or
93	93	investigators commissioned by an emergency services district under
94	94	Chapter 775, Health and Safety Code;
95	95	(34) officers commissioned by the State Board of
96	96	Dental Examiners under Section 254.013, Occupations Code, subject
97	97	to the limitations imposed by that section; [and]
98	98	(35) investigators commissioned by the Texas Juvenile
99	99	Probation Commission as officers under Section 141.055, Human
100	100	Resources Code; and
101	101	(36) the fire marshal and any related officers,
102	102	inspectors, or investigators commissioned by a county under
103	103	Subchapter B, Chapter 352, Local Government Code.
104	104	SECTION 2. This Act takes effect immediately if it receives
105	105	a vote of two-thirds of all the members elected to each house, as
106	106	provided by Section 39, Article III, Texas Constitution. If this
107	107	Act does not receive the vote necessary for immediate effect, this
108	108	Act takes effect September 1, 2009.
