88 relating to the administration of the compensation to victims of
99 crime fund and the compensation to victims of crime auxiliary fund.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article 56.54, Code of Criminal Procedure, is
1212 amended by adding Subsection (m) to read as follows:
1313 (m) Not later than September 15 of each year, the attorney
1414 general, after consulting with the comptroller, shall certify the
1515 amount of money remaining in the compensation to victims of crime
1616 auxiliary fund at the end of the preceding state fiscal year. If
1717 the amount remaining in the fund exceeds $5 million, as soon as
1818 practicable after the date of certification, the attorney general
1919 may transfer from that excess amount in the compensation to victims
2020 of crime auxiliary fund to the compensation to victims of crime fund
2121 an amount that is not more than 50 percent of the excess amount in
2222 the auxiliary fund, to be used only for the purpose of making
2323 compensation payments during the fiscal year in which the amount is
2424 transferred.
2525 SECTION 2. Article 56.541(b), Code of Criminal Procedure,
2626 is amended to read as follows:
2727 (b) At the time the attorney general certifies the estimates
2828 made under Subsection (a), the attorney general shall also certify
2929 for the next state fiscal biennium the amount of excess money in the
3030 compensation to victims of crime fund available for the purposes of
3131 Subsection (c), calculated by multiplying [subtracting] the amount
3232 estimated under Subsection (a)(2) by 105 percent, and subtracting
3333 that product from the sum of the amounts estimated under
3434 Subsections (a)(1) and (a)(3).
3535 SECTION 3. The attorney general may not transfer money
3636 under Article 56.54(m), Code of Criminal Procedure, as added by
3737 this Act, before the 2011 state fiscal year.
3838 SECTION 4. This Act takes effect September 1, 2009.
