| 6 | 6 | | respondent of a complaint filed with the Texas Ethics Commission. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 571.123(b), Government Code, is amended |
|---|
| 9 | 9 | | to read as follows: |
|---|
| 10 | 10 | | (b) After a complaint is filed, the commission shall |
|---|
| 11 | 11 | | immediately attempt to contact and notify the respondent of the |
|---|
| 12 | 12 | | complaint by telephone or electronic mail. Not later than the fifth |
|---|
| 13 | 13 | | business day after the date a complaint is filed, the commission |
|---|
| 14 | 14 | | shall send written notice to the complainant and the respondent. |
|---|
| 15 | 15 | | The written notice to the complainant and the respondent must: |
|---|
| 16 | 16 | | (1) state whether the complaint complies with the form |
|---|
| 17 | 17 | | requirements of Section 571.122; and |
|---|
| 18 | 18 | | (2) if applicable, include the information required by |
|---|
| 19 | 19 | | Section 571.124(e). |
|---|
| 20 | 20 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 21 | 21 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 22 | 22 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 23 | 23 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 24 | 24 | | Act takes effect September 1, 2009. |
