66 AN ACT
77 relating to a pilot project for a drug and alcohol abuse recovery
88 high school program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 29, Education Code, is
1111 amended by adding Section 29.921 to read as follows:
1212 Sec. 29.921. DRUG AND ALCOHOL ABUSE RECOVERY HIGH SCHOOL
1313 PILOT PROJECT. (a) The agency shall develop a pilot project for
1414 the establishment and operation of one or more high school programs
1515 designed to assist students who have completed a drug or alcohol
1616 abuse treatment program in returning to school and earning a high
1717 school diploma.
1818 (b) A high school program established and operated under
1919 this section must provide for:
2020 (1) individualized instruction for students and a low
2121 ratio of students to teachers;
2222 (2) provision of the courses, including dual credit
2323 courses, instruction, and assistance necessary for students to
2424 earn the credits required for high school graduation as required
2525 under Section 28.025;
2626 (3) varied methods of instruction, including
2727 traditional classroom and textbook instruction, self-paced
2828 instruction, and distance learning;
2929 (4) accelerated timelines for advancement between
3030 courses;
3131 (5) assistance with the transition from the treatment
3232 program back to school, including counseling that meets the social
3333 and emotional needs of students and help through peer support
3434 groups;
3535 (6) clear rules of behavior established under an
3636 agreement signed by a program representative, the student, and the
3737 student's parent that:
3838 (A) provides expectations concerning attendance,
3939 achievement, clothing, and Internet use;
4040 (B) requires periodic testing for and prohibits
4141 student drug and alcoholic beverage use; and
4242 (C) prohibits smoking on campus;
4343 (7) required participation in community service
4444 projects; and
4545 (8) establishment of goals by students and procedures
4646 to measure students' accomplishment of those goals.
4747 (c) A high school program established and operated under
4848 this section must establish an application form and a procedure for
4949 admission to the program that, among any other requirements,
5050 requires an applicant for admission to:
5151 (1) apply in writing in the time and manner required by
5252 the program;
5353 (2) interview in person with program representatives;
5454 (3) submit an essay written while visiting the program
5555 site;
5656 (4) submit with the application:
5757 (A) proof in the form required by the program
5858 that the student has completed a drug or alcohol abuse treatment
5959 program approved by the high school program;
6060 (B) the student's transcript and other records
6161 from each school the student has previously attended, including any
6262 results from standardized or state-administered assessment
6363 instruments, disciplinary records, and attendance reports; and
6464 (C) written authorization for program
6565 representatives to obtain specific confidential records of the
6666 student; and
6767 (5) be assessed by drug and alcohol counseling
6868 professionals.
6969 (d) As part of the pilot project, the agency shall develop:
7070 (1) written information for students, parents,
7171 educators, and drug and alcohol abuse treatment centers concerning
7272 the program; and
7373 (2) training for program personnel concerning drug and
7474 alcohol abuse issues, including treatment for drug and alcohol
7575 abuse.
7676 (e) The commissioner may accept gifts, grants, and
7777 donations for developing the pilot project and for a high school
7878 program established and operated as part of the pilot project.
7979 SECTION 2. This Act takes effect immediately if it receives
8080 a vote of two-thirds of all the members elected to each house, as
8181 provided by Section 39, Article III, Texas Constitution. If this
8282 Act does not receive the vote necessary for immediate effect, this
8383 Act takes effect September 1, 2009.
