7	7	relating to the use of certain revenue from oversize and overweight
8	8	vehicle permits for the Texas rail relocation and improvement fund.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 623.0111(c), Transportation Code, is
11	11	amended to read as follows:
12	12	(c) Of the fees collected under Subsection (a) the following
13	13	amounts shall be deposited to the general revenue fund and the
14	14	remainder shall be deposited to the credit of the Texas rail
15	15	relocation and improvement fund [state highway fund]:

34	34	SECTION 2. Sections 623.076(a-1) and (c), Transportation

52	52	(c) An application for a permit under Section 623.071(c)(3)
53	53	or (d) must be accompanied by the permit fee established by the
54	54	commission for the permit, not to exceed $7,000. Of each fee
55	55	collected under this subsection, the department shall send:
56	56	(1) the first $1,000 to the comptroller for deposit to
57	57	the credit of the general revenue fund; and
58	58	(2) any amount in excess of $1,000 to the comptroller
59	59	for deposit to the credit of the Texas rail relocation and
60	60	improvement fund [state highway fund].
61	61	SECTION 3. Section 623.078(b), Transportation Code, is
62	62	amended to read as follows:
63	63	(b) The department shall send each fee collected under
64	64	Subsection (a) to the comptroller for deposit to the credit of the
65	65	Texas rail relocation and improvement fund [state highway fund].
66	66	SECTION 4. Section 623.096(a), Transportation Code, is
67	67	amended to read as follows:
68	68	(a) The department shall collect a fee of $40 for each
69	69	permit issued under this subchapter. Of each fee, $19.70 shall be
70	70	deposited to the credit of the general revenue fund and the
71	71	remainder deposited to the credit of the Texas rail relocation and
72	72	improvement fund [state highway fund].
73	73	SECTION 5. Section 623.124(b), Transportation Code, is
74	74	amended to read as follows:
75	75	(b) The department shall send each fee collected under this
76	76	section to the comptroller. Of each fee received from the
77	77	department, the comptroller shall deposit $7.50 to the credit of
78	78	the general revenue fund and $7.50 to the credit of the Texas rail
79	79	relocation and improvement fund [state highway fund].
80	80	SECTION 6. Section 623.182(b), Transportation Code, is
81	81	amended to read as follows:
82	82	(b) The department shall send each fee collected under this
83	83	subchapter to the comptroller. Of each fee received from the
84	84	department, the comptroller shall deposit $50 to the credit of the
85	85	general revenue fund and $50 to the credit of the Texas rail
86	86	relocation and improvement fund [state highway fund].
87	87	SECTION 7. This Act takes effect September 1, 2009.
