| 7 | 7 | | relating to the creation of legislative committees to study |
|---|
| 8 | 8 | | proposals on the conduct of gaming in this state. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. (a) The House Gaming Legislation Review |
|---|
| 11 | 11 | | Committee and the Senate Gaming Legislation Review Committee are |
|---|
| 12 | 12 | | created to review, evaluate, and recommend legislative proposals to |
|---|
| 13 | 13 | | authorize gaming in this state in counties that by local option |
|---|
| 14 | 14 | | election approve the conduct of gaming in the county. |
|---|
| 15 | 15 | | (b) The House Gaming Legislation Review Committee is |
|---|
| 16 | 16 | | composed of 17 members of the house of representatives appointed by |
|---|
| 17 | 17 | | the speaker of the house of representatives. |
|---|
| 18 | 18 | | (c) The Senate Gaming Legislation Review Committee is |
|---|
| 19 | 19 | | composed of 17 members of the senate appointed by the lieutenant |
|---|
| 20 | 20 | | governor or 16 members of the senate appointed by the lieutenant |
|---|
| 21 | 21 | | governor and the lieutenant governor, as determined by the |
|---|
| 22 | 22 | | lieutenant governor. |
|---|
| 23 | 23 | | (d) Each committee shall select its officers and determine |
|---|
| 24 | 24 | | the rules of its proceedings as each committee considers |
|---|
| 25 | 25 | | appropriate. |
|---|
| 26 | 26 | | (e) Each committee shall conduct public hearings throughout |
|---|
| 27 | 27 | | this state and solicit testimony from interested persons concerning |
|---|
| 28 | 28 | | the legalization of gaming in this state on a local option basis. |
|---|
| 29 | 29 | | (f) Not later than January 1, 2011: |
|---|
| 30 | 30 | | (1) the House Gaming Legislation Review Committee |
|---|
| 31 | 31 | | shall prepare and deliver to the governor and both houses of the |
|---|
| 32 | 32 | | legislature a report containing the committee's findings and |
|---|
| 33 | 33 | | recommendations for legislation to authorize and regulate the |
|---|
| 34 | 34 | | conduct of gaming in this state in counties that by local option |
|---|
| 35 | 35 | | election approve the conduct of gaming in the county; and |
|---|
| 36 | 36 | | (2) the Senate Gaming Legislation Review Committee |
|---|
| 37 | 37 | | shall prepare and deliver to the governor and both houses of the |
|---|
| 38 | 38 | | legislature a report containing the committee's findings and |
|---|
| 39 | 39 | | recommendations for legislation to authorize and regulate the |
|---|
| 40 | 40 | | conduct of gaming in this state in counties that by local option |
|---|
| 41 | 41 | | election approve the conduct of gaming in the county. |
|---|
| 42 | 42 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 43 | 43 | | of this Act: |
|---|
| 44 | 44 | | (1) the speaker of the house of representatives shall |
|---|
| 45 | 45 | | make the appointments to the House Gaming Legislation Review |
|---|
| 46 | 46 | | Committee; and |
|---|
| 47 | 47 | | (2) the lieutenant governor shall make the |
|---|
| 48 | 48 | | appointments to the Senate Gaming Legislation Review Committee. |
|---|
| 49 | 49 | | SECTION 3. The House Gaming Legislation Review Committee |
|---|
| 50 | 50 | | and the Senate Gaming Legislation Review Committee are abolished |
|---|
| 51 | 51 | | and this Act expires on January 2, 2011. |
|---|
| 52 | 52 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 53 | 53 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 54 | 54 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 55 | 55 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 56 | 56 | | Act takes effect September 1, 2009. |
