55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the creation of legislative committees to study
88 proposals on the conduct of gaming in this state.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. (a) The House Gaming Legislation Review
1111 Committee and the Senate Gaming Legislation Review Committee are
1212 created to review, evaluate, and recommend legislative proposals to
1313 authorize gaming in this state in counties that by local option
1414 election approve the conduct of gaming in the county.
1515 (b) The House Gaming Legislation Review Committee is
1616 composed of 17 members of the house of representatives appointed by
1717 the speaker of the house of representatives.
1818 (c) The Senate Gaming Legislation Review Committee is
1919 composed of 17 members of the senate appointed by the lieutenant
2020 governor or 16 members of the senate appointed by the lieutenant
2121 governor and the lieutenant governor, as determined by the
2222 lieutenant governor.
2323 (d) Each committee shall select its officers and determine
2424 the rules of its proceedings as each committee considers
2525 appropriate.
2626 (e) Each committee shall conduct public hearings throughout
2727 this state and solicit testimony from interested persons concerning
2828 the legalization of gaming in this state on a local option basis.
2929 (f) Not later than January 1, 2011:
3030 (1) the House Gaming Legislation Review Committee
3131 shall prepare and deliver to the governor and both houses of the
3232 legislature a report containing the committee's findings and
3333 recommendations for legislation to authorize and regulate the
3434 conduct of gaming in this state in counties that by local option
3535 election approve the conduct of gaming in the county; and
3636 (2) the Senate Gaming Legislation Review Committee
3737 shall prepare and deliver to the governor and both houses of the
3838 legislature a report containing the committee's findings and
3939 recommendations for legislation to authorize and regulate the
4040 conduct of gaming in this state in counties that by local option
4141 election approve the conduct of gaming in the county.
4242 SECTION 2. As soon as practicable after the effective date
4343 of this Act:
4444 (1) the speaker of the house of representatives shall
4545 make the appointments to the House Gaming Legislation Review
4646 Committee; and
4747 (2) the lieutenant governor shall make the
4848 appointments to the Senate Gaming Legislation Review Committee.
4949 SECTION 3. The House Gaming Legislation Review Committee
5050 and the Senate Gaming Legislation Review Committee are abolished
5151 and this Act expires on January 2, 2011.
5252 SECTION 4. This Act takes effect immediately if it receives
5353 a vote of two-thirds of all the members elected to each house, as
5454 provided by Section 39, Article III, Texas Constitution. If this
5555 Act does not receive the vote necessary for immediate effect, this
5656 Act takes effect September 1, 2009.
