 A BILL TO BE ENTITLED
 AN ACT
 relating to a grant program for after-school child-care programs
 provided by school districts.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Subchapter Z, Chapter 33, Education Code, is
 amended by adding Section 33.904 to read as follows:
 Sec. 33.904.  GRANTS FOR AFTER-SCHOOL CHILD-CARE PROGRAMS.
 (a) From funds appropriated for the purpose, the commissioner
 shall make grants to school districts for use in operating one or
 more after-school child-care programs for students enrolled in
 kindergarten through grade eight.
 (b)  To be eligible for a grant under this section, a school
 district must apply to the commissioner in the manner and within the
 time prescribed by the commissioner.
 (c)  In awarding grants under this section, the commissioner
 shall give priority to a school district that:
 (1) is located primarily in a county:
 (A) with a population of less than 500,000; and
 (B)  in which a majority of the enrolled public
 school students are from low-income families; and
 (2)  proposes to use the grant to operate an
 after-school child-care program at one or more schools in which a
 significant number of the enrolled students are from low-income
 families.
 (d)  The commissioner shall adopt rules to administer this
 section, including rules defining "low-income families" for
 purposes of Subsection (c).
 SECTION 2. This Act takes effect September 1, 2009.
