| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter C, Chapter 61, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 61.0861 to read as follows: |
|---|
| 13 | 13 | | Sec. 61.0861. FACULTY AND STAFF RECRUITMENT AND RETENTION |
|---|
| 14 | 14 | | STRATEGY. (a) The board shall develop and annually update a |
|---|
| 15 | 15 | | strategy to enable institutions of higher education to identify, |
|---|
| 16 | 16 | | attract, hire, and retain faculty and staff who reflect the |
|---|
| 17 | 17 | | population of this state. |
|---|
| 18 | 18 | | (b) Each institution of higher education shall implement |
|---|
| 19 | 19 | | the elements of the strategy developed under Subsection (a) |
|---|
| 20 | 20 | | applicable to the institution as provided by the board. Each |
|---|
| 21 | 21 | | institution shall report annually to the board the manner in which |
|---|
| 22 | 22 | | the institution has implemented the applicable elements of the |
|---|
| 23 | 23 | | strategy. |
|---|
| 24 | 24 | | SECTION 2. The Texas Higher Education Coordinating Board |
|---|
| 25 | 25 | | shall adopt the strategy required by Section 61.0861, Education |
|---|
| 26 | 26 | | Code, as added by this Act, not later than January 1, 2010. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2009. |
