 A BILL TO BE ENTITLED
 AN ACT
 relating to assessing the effectiveness of certain developmental
 education courses for students enrolled in public institutions of
 higher education.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 51.3062, Education Code, is amended by
 adding Subsection (o-1) to read as follows:
 (o-1)  As part of its evaluation under Subsection (o), the
 board shall examine the success rates of students taking
 developmental coursework through alternative methods to
 traditional semester-long courses, including through intensive or
 flexible courses of substantially shorter duration, and shall
 compare those success rates with the success rates of students
 taking developmental coursework through traditional courses. In
 comparing success rates, the board shall analyze student
 performance on subsequent assessment instruments and academic
 coursework and student retention and degree program completion
 rates. The board shall periodically make recommendations to each
 institution of higher education regarding developmental coursework
 offered through alternative methods based on the board's evaluation
 under this subsection.
 SECTION 2. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
