99 relating to alternative developmental education courses under the
1010 Texas Success Initiative for institutions of higher education.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 51.3062(i), Education Code, is amended
1313 to read as follows:
1414 (i) The institution of higher education may refer a student
1515 to developmental coursework as considered necessary by the
1616 institution to address a student's deficiencies in the student's
1717 readiness to perform freshman-level academic coursework, except
1818 that the institution may not require enrollment in developmental
1919 coursework with respect to a student previously determined by any
2020 institution of higher education to have met college-readiness
2121 standards. An institution of higher education that requires a
2222 student to enroll in developmental coursework must offer the
2323 student the option of enrolling in developmental coursework in an
2424 intensive or compressed course-based format that, to the extent
2525 possible, allows the student to enroll in developmental courses
2626 without substantially conflicting with other coursework or the
2727 student's overall academic progress if under rules of the Texas
2828 Higher Education Coordinating Board the student is determined to be
2929 eligible to enroll in developmental courses offered in that format.
3030 The coordinating board shall adopt rules prescribing:
3131 (1) student eligibility criteria for enrolling in an
3232 intensive or compressed course-based format under this subsection;
3333 and
3434 (2) requirements for approving the use of an intensive
3535 or compressed course-based format.
3636 SECTION 2. The change in law made by this Act applies
3737 beginning with the 2010-2011 academic year.
3838 SECTION 3. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect September 1, 2009.
