| 10 | 10 | | Texas Success Initiative for institutions of higher education. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 51.3062(i), Education Code, is amended |
|---|
| 13 | 13 | | to read as follows: |
|---|
| 14 | 14 | | (i) The institution of higher education may refer a student |
|---|
| 15 | 15 | | to developmental coursework as considered necessary by the |
|---|
| 16 | 16 | | institution to address a student's deficiencies in the student's |
|---|
| 17 | 17 | | readiness to perform freshman-level academic coursework, except |
|---|
| 18 | 18 | | that the institution may not require enrollment in developmental |
|---|
| 19 | 19 | | coursework with respect to a student previously determined by any |
|---|
| 20 | 20 | | institution of higher education to have met college-readiness |
|---|
| 21 | 21 | | standards. An institution of higher education that requires a |
|---|
| 22 | 22 | | student to enroll in developmental coursework must offer the |
|---|
| 23 | 23 | | student the option of enrolling in developmental coursework in an |
|---|
| 24 | 24 | | intensive or compressed course-based format that, to the extent |
|---|
| 25 | 25 | | possible, allows the student to enroll in developmental courses |
|---|
| 26 | 26 | | without substantially conflicting with other coursework or the |
|---|
| 27 | 27 | | student's overall academic progress if under rules of the Texas |
|---|
| 28 | 28 | | Higher Education Coordinating Board the student is determined to be |
|---|
| 29 | 29 | | eligible to enroll in developmental courses offered in that format. |
|---|
| 30 | 30 | | The coordinating board shall adopt rules prescribing: |
|---|
| 31 | 31 | | (1) student eligibility criteria for enrolling in an |
|---|
| 32 | 32 | | intensive or compressed course-based format under this subsection; |
|---|
| 33 | 33 | | and |
|---|
| 34 | 34 | | (2) requirements for approving the use of an intensive |
|---|
| 35 | 35 | | or compressed course-based format. |
|---|
| 36 | 36 | | SECTION 2. The change in law made by this Act applies |
|---|
| 37 | 37 | | beginning with the 2010-2011 academic year. |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 39 | 39 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 40 | 40 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 41 | 41 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 42 | 42 | | Act takes effect September 1, 2009. |
