55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to ensuring that health information technology used in the
88 medical assistance and child health plan programs conforms to
99 certain standards.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1212 is amended by adding Section 32.073 to read as follows:
1313 Sec. 32.073. HEALTH INFORMATION TECHNOLOGY STANDARDS. (a)
1414 In this section, "health information technology" means information
1515 technology used to improve the quality, safety, or efficiency of
1616 clinical practice, including the core functionalities of an
1717 electronic health record, an electronic medical record, a
1818 computerized physician or health care provider order entry,
1919 electronic prescribing, and clinical decision support technology.
2020 (b) The Health and Human Services Commission shall ensure
2121 that any health information technology used in the medical
2222 assistance program conforms to the standards adopted by the
2323 Healthcare Information Technology Standards Panel sponsored by the
2424 American National Standards Institute.
2525 SECTION 2. Subchapter B, Chapter 62, Health and Safety
2626 Code, is amended by adding Section 62.060 to read as follows:
2727 Sec. 62.060. HEALTH INFORMATION TECHNOLOGY STANDARDS. (a)
2828 In this section, "health information technology" means information
2929 technology used to improve the quality, safety, or efficiency of
3030 clinical practice, including the core functionalities of an
3131 electronic health record, an electronic medical record, a
3232 computerized physician or health care provider order entry,
3333 electronic prescribing, and clinical decision support technology.
3434 (b) The commission shall ensure that any health information
3535 technology used in the child health plan program conforms to the
3636 standards adopted by the Healthcare Information Technology
3737 Standards Panel sponsored by the American National Standards
3838 Institute.
3939 SECTION 3. If before implementing any provision of this Act
4040 a state agency determines that a waiver or authorization from a
4141 federal agency is necessary for implementation of that provision,
4242 the agency affected by the provision shall request the waiver or
4343 authorization and may delay implementing that provision until the
4444 waiver or authorization is granted.
4545 SECTION 4. This Act takes effect immediately if it receives
4646 a vote of two-thirds of all the members elected to each house, as
4747 provided by Section 39, Article III, Texas Constitution. If this
4848 Act does not receive the vote necessary for immediate effect, this
4949 Act takes effect September 1, 2009.
