55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the discipline of public school students.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 37.001(a), Education Code, is amended to
1010 read as follows:
1111 (a) The board of trustees of an independent school district
1212 shall, with the advice of its district-level committee established
1313 under Subchapter F, Chapter 11, adopt a student code of conduct for
1414 the district. The student code of conduct must be posted and
1515 prominently displayed at each school campus or made available for
1616 review at the office of the campus principal. In addition to
1717 establishing standards for student conduct, the student code of
1818 conduct must:
1919 (1) specify the circumstances, in accordance with this
2020 subchapter, under which a student may be removed from a classroom,
2121 campus, or disciplinary alternative education program;
2222 (2) specify conditions that authorize or require a
2323 principal or other appropriate administrator to transfer a student
2424 to a disciplinary alternative education program;
2525 (3) outline conditions under which a student may be
2626 suspended as provided by Section 37.005 or expelled as provided by
2727 Section 37.007;
2828 (4) specify that [whether] consideration will be [is]
2929 given, as a factor in a decision regarding [to order] suspension,
3030 removal to a disciplinary alternative education program, or
3131 expulsion, to:
3232 (A) self-defense;
3333 (B) intent or lack of intent at the time the
3434 student engaged in the conduct;
3535 (C) a student's disciplinary history; or
3636 (D) a disability that substantially impairs the
3737 student's capacity to appreciate the wrongfulness of the student's
3838 conduct;
3939 (5) provide guidelines for setting the length of a
4040 term of:
4141 (A) a removal under Section 37.006; and
4242 (B) an expulsion under Section 37.007;
4343 (6) address the notification of a student's parent or
4444 guardian of a violation of the student code of conduct committed by
4545 the student that results in suspension, removal to a disciplinary
4646 alternative education program, or expulsion;
4747 (7) prohibit bullying, harassment, and making hit
4848 lists and ensure that district employees enforce those
4949 prohibitions; and
5050 (8) provide, as appropriate for students at each grade
5151 level, methods, including options, for:
5252 (A) managing students in the classroom and on
5353 school grounds;
5454 (B) disciplining students; and
5555 (C) preventing and intervening in student
5656 discipline problems, including bullying, harassment, and making
5757 hit lists.
5858 SECTION 2. Subchapter A, Chapter 37, Education Code, is
5959 amended by adding Section 37.0012 to read as follows:
6060 Sec. 37.0012. DESIGNATION OF CAMPUS DISCIPLINE OFFICER. (a)
6161 A person at each campus must be designated to serve as the campus
6262 discipline officer. The person designated may be the principal of
6363 the campus or any other campus administrator selected by the
6464 principal.
6565 (b) The campus discipline officer is primarily responsible
6666 for maintaining student discipline and the implementation of this
6767 subchapter.
6868 (c) The specific duties of the campus discipline officer may
6969 be established by campus or district policy. Unless otherwise
7070 provided by campus or district policy:
7171 (1) a duty imposed on a campus principal or other
7272 campus administrator under this subchapter shall be performed by
7373 the campus discipline officer; and
7474 (2) a power granted to a campus principal or other
7575 campus administrator under this subchapter may be exercised by the
7676 campus discipline officer.
7777 SECTION 3. Section 37.002, Education Code, is amended by
7878 amending Subsection (a) and adding Subsection (e) to read as
7979 follows:
8080 (a) A teacher may send a student to the campus discipline
8181 officer's [principal's] office to maintain effective discipline in
8282 the classroom. The campus discipline officer [principal] shall
8383 respond by employing appropriate discipline management techniques
8484 consistent with the student code of conduct adopted under Section
8585 37.001 that can reasonably be expected to improve the student's
8686 behavior before returning the student to the classroom.
8787 (e) A school district or employee of a school district may
8888 not retaliate against a teacher for taking action authorized by
8989 this section.
9090 SECTION 4. This Act applies beginning with the 2009-2010
9191 school year.
9292 SECTION 5. This Act takes effect immediately if it receives
9393 a vote of two-thirds of all the members elected to each house, as
9494 provided by Section 39, Article III, Texas Constitution. If this
9595 Act does not receive the vote necessary for immediate effect, this
9696 Act takes effect September 1, 2009.
