8 | 8 | education in a dual usage education complex established by a junior | |

10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 130.0103(a), Education Code, is amended | |
12 | 12 | to read as follows: | |
13 | 13 | (a) The board of trustees of a junior college district may | |
14 | 14 | establish and operate a dual usage educational complex to provide a | |
15 | 15 | shared facility for the educational activities of the district and | |
16 | 16 | other participating entities. The board of trustees may enter into | |
17 | 17 | a cooperative agreement governing the operation and use of the | |
18 | 18 | complex with the governing bodies of one or more of the following | |
19 | 19 | entities: | |
20 | 20 | (1) a county, municipality, or school district located | |
21 | 21 | in whole or in part in the service area of the junior college | |
22 | 22 | district; or | |
23 | 23 | (2) another institution of higher education [with a | |
24 | 24 | campus or other educational facility located in the same state | |
25 | 25 | uniform service region as adopted by the coordinating board]. | |
26 | 26 | SECTION 2. This Act takes effect immediately if it receives | |
27 | 27 | a vote of two-thirds of all the members elected to each house, as | |
28 | 28 | provided by Section 39, Article III, Texas Constitution. If this | |
29 | 29 | Act does not receive the vote necessary for immediate effect, this | |
30 | 30 | Act takes effect September 1, 2009. |
