77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter C, Chapter 161, Agriculture Code, is
99 amended by adding Section 161.0541 to read as follows:
1010 Sec. 161.0541. ELK DISEASE SURVEILLANCE PROGRAM. (a) The
1111 commission by rule may establish a disease surveillance program for
1212 elk.
1313 (b) Rules adopted under this section must:
1414 (1) require each person who moves elk in this state to
1515 have elk tested for chronic wasting disease or other diseases as
1616 determined by the commission;
1717 (2) be designed to protect the health of the elk
1818 population in this state; and
1919 (3) include provisions for testing, identification,
2020 transportation, and inspection under the disease surveillance
2121 program.
2222 (c) A person commits an offense if the person knowingly
2323 violates a rule adopted by the commission under this section.
2424 (d) An offense under Subsection (c) is a Class C misdemeanor
2525 unless it is shown on the trial of the offense that the defendant
2626 has previously been convicted of an offense under that subsection,
2727 in which event the offense is a Class B misdemeanor.
2828 SECTION 2. This Act takes effect September 1, 2009.
