| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subchapter C, Chapter 161, Agriculture Code, is |
|---|
| 9 | 9 | | amended by adding Section 161.0541 to read as follows: |
|---|
| 10 | 10 | | Sec. 161.0541. ELK DISEASE SURVEILLANCE PROGRAM. (a) The |
|---|
| 11 | 11 | | commission by rule may establish a disease surveillance program for |
|---|
| 12 | 12 | | elk. |
|---|
| 13 | 13 | | (b) Rules adopted under this section must: |
|---|
| 14 | 14 | | (1) require each person who moves elk in this state to |
|---|
| 15 | 15 | | have elk tested for chronic wasting disease or other diseases as |
|---|
| 16 | 16 | | determined by the commission; |
|---|
| 17 | 17 | | (2) be designed to protect the health of the elk |
|---|
| 18 | 18 | | population in this state; and |
|---|
| 19 | 19 | | (3) include provisions for testing, identification, |
|---|
| 20 | 20 | | transportation, and inspection under the disease surveillance |
|---|
| 21 | 21 | | program. |
|---|
| 22 | 22 | | (c) A person commits an offense if the person knowingly |
|---|
| 23 | 23 | | violates a rule adopted by the commission under this section. |
|---|
| 24 | 24 | | (d) An offense under Subsection (c) is a Class C misdemeanor |
|---|
| 25 | 25 | | unless it is shown on the trial of the offense that the defendant |
|---|
| 26 | 26 | | has previously been convicted of an offense under that subsection, |
|---|
| 27 | 27 | | in which event the offense is a Class B misdemeanor. |
|---|
| 28 | 28 | | SECTION 2. This Act takes effect September 1, 2009. |
