99 relating to local option alcoholic beverage elections to change the
1010 status of an existing voting unit.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 251.72, Alcoholic Beverage Code, is
1313 amended to read as follows:
1414 Sec. 251.72. CHANGE OF STATUS. (a) Except as provided in
1515 Section 251.73 [of this code], an authorized voting unit that has
1616 exercised or may exercise the right of local option retains the
1717 status adopted, whether absolute prohibition or legalization of the
1818 sale of alcoholic beverages of one or more of the various types and
1919 alcoholic contents on which an issue may be submitted under the
2020 terms of Section 501.035, Election Code, until that status is
2121 changed by a subsequent local option election in the same
2222 authorized voting unit.
2323 (b) Except as provided by Subsection (c), a subsequent local
2424 option election shall be held within the boundaries of the
2525 authorized voting unit as they exist on the date of the election,
2626 and the results of the election are effective within those
2727 boundaries.
2828 (c) Subsection (b) does not apply to a local option election
2929 in a justice precinct in a county containing only one justice
3030 precinct.
3131 SECTION 2. Section 251.80, Alcoholic Beverage Code, is
3232 amended by adding Subsection (d) to read as follows:
3333 (d) This section applies only to a county containing only
3434 one justice precinct.
3535 SECTION 3. This Act takes effect September 1, 2009.
