| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 251.72, Alcoholic Beverage Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | Sec. 251.72. CHANGE OF STATUS. (a) Except as provided in |
|---|
| 15 | 15 | | Section 251.73 [of this code], an authorized voting unit that has |
|---|
| 16 | 16 | | exercised or may exercise the right of local option retains the |
|---|
| 17 | 17 | | status adopted, whether absolute prohibition or legalization of the |
|---|
| 18 | 18 | | sale of alcoholic beverages of one or more of the various types and |
|---|
| 19 | 19 | | alcoholic contents on which an issue may be submitted under the |
|---|
| 20 | 20 | | terms of Section 501.035, Election Code, until that status is |
|---|
| 21 | 21 | | changed by a subsequent local option election in the same |
|---|
| 22 | 22 | | authorized voting unit. |
|---|
| 23 | 23 | | (b) Except as provided by Subsection (c), a subsequent local |
|---|
| 24 | 24 | | option election shall be held within the boundaries of the |
|---|
| 25 | 25 | | authorized voting unit as they exist on the date of the election, |
|---|
| 26 | 26 | | and the results of the election are effective within those |
|---|
| 27 | 27 | | boundaries. |
|---|
| 28 | 28 | | (c) Subsection (b) does not apply to a local option election |
|---|
| 29 | 29 | | in a justice precinct in a county containing only one justice |
|---|
| 30 | 30 | | precinct. |
|---|
| 31 | 31 | | SECTION 2. Section 251.80, Alcoholic Beverage Code, is |
|---|
| 32 | 32 | | amended by adding Subsection (d) to read as follows: |
|---|
| 33 | 33 | | (d) This section applies only to a county containing only |
|---|
| 34 | 34 | | one justice precinct. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect September 1, 2009. |
