88 AN ACT
99 relating to the cost of replacing a law enforcement officer during
1010 training on enforcement of immigration laws.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 772.006(a), Government Code, is amended
1313 to read as follows:
1414 (a) The governor shall establish a criminal justice
1515 division in the governor's office to:
1616 (1) advise and assist the governor in developing
1717 policies, plans, programs, and proposed legislation for improving
1818 the coordination, administration, and effectiveness of the
1919 criminal justice system;
2020 (2) administer the criminal justice planning fund;
2121 (3) prepare a state comprehensive criminal justice
2222 plan, to update the plan annually based on an analysis of the
2323 state's criminal justice problems and needs, and to encourage
2424 identical or substantially similar local and regional
2525 comprehensive criminal justice planning efforts;
2626 (4) establish goals, priorities, and standards for
2727 programs and projects to improve the administration of justice and
2828 the efficiency of law enforcement, the judicial system,
2929 prosecution, criminal defense, and adult and juvenile corrections
3030 and rehabilitation;
3131 (5) award grants to state agencies, units of local
3232 government, school districts, and private, nonprofit corporations
3333 from the criminal justice planning fund for programs and projects
3434 on consideration of the goals, priorities, and standards
3535 recommended by the Criminal Justice Policy Council;
3636 (6) apply for, obtain, and allocate for the purposes
3737 of this section any federal or other funds which may be made
3838 available for programs and projects that address the goals,
3939 priorities, and standards established in local and regional
4040 comprehensive criminal justice planning efforts or assist those
4141 efforts;
4242 (7) administer the funds provided by this section in
4343 such a manner as to ensure that grants received under this section
4444 do not supplant state or local funds;
4545 (8) monitor and evaluate programs and projects funded
4646 under this section, cooperate with and render technical assistance
4747 to state agencies and local governments seeking to reduce crime or
4848 enhance the performance and operation of the criminal justice
4949 system, and collect from any state or local government entity
5050 information, data, statistics, or other material necessary to carry
5151 out the purposes of this section;
5252 (9) submit a biennial report to the legislature
5353 reporting the division's activities during the preceding biennium
5454 including the comprehensive state criminal justice plans and other
5555 studies, evaluations, crime data analyses, reports, or proposed
5656 legislation that the governor determines appropriate or the
5757 legislature requests; [and]
5858 (10) pay, on application by a unit of local
5959 government, the cost incurred to replace a law enforcement officer
6060 during the period that the law enforcement officer is receiving
6161 training by the federal Immigration and Customs Enforcement Agency,
6262 or its successor agency, on the enforcement of federal immigration
6363 law, provided that the unit of local government has signed a
6464 memorandum of understanding limiting enforcement to 8 U.S.C.
6565 Section 1252c; and
6666 (11) perform other duties as necessary to carry out
6767 the duties listed in this subsection and adopt rules and procedures
6868 as necessary.
6969 SECTION 2. The changes in law made by this Act to Section
7070 772.006(a), Government Code, apply only to training that occurs on
7171 or after the effective date of this Act.
7272 SECTION 3. This Act takes effect September 1, 2009.
