8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Subchapter E, Chapter 31, Election Code, is | |
10 | 10 | amended by adding Section 31.124 to read as follows: | |
11 | 11 | Sec. 31.124. PROVISION OF NOTICE TO COUNTY CHAIRS BY | |
12 | 12 | ELECTION AUTHORITY. (a) In this section, "election authority" | |
13 | 13 | means the county clerk or secretary of the governing body of a | |
14 | 14 | political subdivision other than a county or city or the authority | |
15 | 15 | performing the duties of a secretary for that political subdivision | |
16 | 16 | under this code. | |
17 | 17 | (b) Each election authority shall deliver written notice of | |
18 | 18 | the time and place of any meeting concerning an election called by | |
19 | 19 | the election authority not later than the fourth day before the | |
20 | 20 | meeting date to the county chair of each political party that made | |
21 | 21 | nominations by primary election for the general election for state | |
22 | 22 | and county officers preceding the date of the meeting. | |
23 | 23 | SECTION 2. This Act takes effect immediately if it receives | |
24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
27 | 27 | Act takes effect September 1, 2009. |
