88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter E, Chapter 31, Election Code, is
1010 amended by adding Section 31.124 to read as follows:
1111 Sec. 31.124. PROVISION OF NOTICE TO COUNTY CHAIRS BY
1212 ELECTION AUTHORITY. (a) In this section, "election authority"
1313 means the county clerk or secretary of the governing body of a
1414 political subdivision other than a county or city or the authority
1515 performing the duties of a secretary for that political subdivision
1616 under this code.
1717 (b) Each election authority shall deliver written notice of
1818 the time and place of any meeting concerning an election called by
1919 the election authority not later than the fourth day before the
2020 meeting date to the county chair of each political party that made
2121 nominations by primary election for the general election for state
2222 and county officers preceding the date of the meeting.
2323 SECTION 2. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2009.
