10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 2303.003(8), Government Code, is amended |
---|
12 | 12 | | to read as follows: |
---|
13 | 13 | | (8) "Qualified hotel project" means a hotel proposed |
---|
14 | 14 | | to be constructed by a municipality, a county, or a nonprofit |
---|
15 | 15 | | municipally sponsored or county-sponsored local government |
---|
16 | 16 | | corporation created under the Texas Transportation Corporation |
---|
17 | 17 | | Act, Chapter 431, Transportation Code, that is within 1,000 feet of |
---|
18 | 18 | | a convention center owned by a municipality having a population of |
---|
19 | 19 | | 1,500,000 or more or a county having a population of 3.3 million or |
---|
20 | 20 | | more, as appropriate, including shops, parking facilities, and any |
---|
21 | 21 | | other facilities ancillary to the hotel. |
---|
22 | 22 | | SECTION 2. Section 2303.505(a), Government Code, is amended |
---|
23 | 23 | | to read as follows: |
---|
24 | 24 | | (a) To encourage the development of areas designated as |
---|
25 | 25 | | enterprise zones, the governing body of a municipality or county |
---|
26 | 26 | | through a program may refund its local sales and use taxes paid by a |
---|
27 | 27 | | qualified business on all taxable items purchased for use at the |
---|
28 | 28 | | qualified business site related to the project or activity. |
---|
29 | 29 | | SECTION 3. Section 2303.505(a), Government Code, as amended |
---|
30 | 30 | | by this Act, applies only to the refund of local sales and use taxes |
---|
31 | 31 | | paid on or after the effective date of this Act. |
---|
32 | 32 | | SECTION 4. This Act takes effect September 1, 2009. |
