9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 416.001, Property Code, is amended to | |
11 | 11 | read as follows: | |
12 | 12 | Sec. 416.001. REGISTRATION REQUIRED. (a) A person may not | |
13 | 13 | act as a builder unless the person holds a certificate of | |
14 | 14 | registration under this chapter. | |
15 | 15 | (b) A person commits an offense if the person violates | |
16 | 16 | Subsection (a). An offense under this section is a Class A | |
17 | 17 | misdemeanor. | |
18 | 18 | SECTION 2. Section 416.001, Property Code, as amended by | |
19 | 19 | this Act, applies only to an offense committed on or after the | |
20 | 20 | effective date of this Act. An offense committed before the | |
21 | 21 | effective date of this Act is governed by the law in effect at the | |
22 | 22 | time the offense was committed, and the former law is continued in | |
23 | 23 | effect for that purpose. For the purposes of this section, an | |
24 | 24 | offense was committed before the effective date of this Act if any | |
25 | 25 | element of the offense occurred before that date. | |
26 | 26 | SECTION 3. This Act takes effect September 1, 2009. |
