 A BILL TO BE ENTITLED
 AN ACT
 relating to elimination of an assets limit for purposes of
 determining eligibility for a Medicare savings program.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Subchapter B, Chapter 531, Government Code, is
 amended by adding Section 531.0681 to read as follows:
 Sec. 531.0681.  MEDICARE SAVINGS PROGRAMS ELIGIBILITY
 GUIDELINES. (a) For purposes of this section, "Medicare savings
 program" means a program under which a person receives assistance
 through the Medicaid program in paying premiums, coinsurance,
 deductibles, or other costs incurred by the person under the
 Medicare program.
 (b)  In determining eligibility for a Medicare savings
 program, the commission may not limit the amount of an applicant's
 assets.
 SECTION 2. If before implementing any provision of this Act
 a state agency determines that a waiver or authorization from a
 federal agency is necessary for implementation of that provision,
 the agency affected by the provision shall request the waiver or
 authorization and may delay implementing that provision until the
 waiver or authorization is granted.
 SECTION 3. This Act takes effect September 1, 2009.
