6 | 6 | | certain counties to create housing communities for veterans. |

7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 8 | | SECTION 1. Subchapter D, Chapter 392, Local Government |
---|
9 | 9 | | Code, is amended by adding Section 392.067 to read as follows: |
---|
10 | 10 | | Sec. 392.067. VETERANS HOUSING IN CERTAIN COUNTIES. (a) In |
---|
11 | 11 | | this section, "veteran" means a person who has served on active duty |
---|
12 | 12 | | in the armed forces of the United States or in the state military |
---|
13 | 13 | | forces as defined by Section 431.001, Government Code. |
---|
14 | 14 | | (b) A county or municipal housing authority in a county with |
---|
15 | 15 | | a population of more than 500,000 may borrow money, accept grants, |
---|
16 | 16 | | and exercise its powers to provide safe and sanitary housing |
---|
17 | 17 | | communities for veterans. |
---|
18 | 18 | | (c) As the authority considers necessary to achieve the |
---|
19 | 19 | | purposes of this chapter, an authority may enter into a lease or |
---|
20 | 20 | | purchase agreement or accept a conveyance regarding real property |
---|
21 | 21 | | as part of a housing project that will benefit veterans. The |
---|
22 | 22 | | agreement or conveyance may include any restrictive covenants that |
---|
23 | 23 | | the authority considers appropriate regarding the property. As the |
---|
24 | 24 | | authority considers necessary and on the stipulation of the |
---|
25 | 25 | | parties, the covenants run with the property. |
---|
26 | 26 | | (d) A county or municipal housing authority to which this |
---|
27 | 27 | | section applies is not subject to the limitations in Section |
---|
28 | 28 | | 392.014, 392.015, or 392.017 with respect to a housing project that |
---|
29 | 29 | | benefits veterans as authorized by this section. |
---|
30 | 30 | | SECTION 2. This Act takes effect September 1, 2009. |
