6	6	AN ACT
7	7	relating to projects that may be undertaken by development
8	8	corporations for the development, retention, or expansion of
9	9	certain transportation facilities.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Section 501.101, Local Government Code, as
12	12	effective September 1, 2009, is amended to read as follows:
13	13	Sec. 501.101. PROJECTS RELATED TO CREATION OR RETENTION OF
14	14	PRIMARY JOBS. In this subtitle, "project" includes the land,
15	15	buildings, equipment, facilities, expenditures, targeted
16	16	infrastructure, and improvements that are:
17	17	(1) for the creation or retention of primary jobs; and
18	18	(2) found by the board of directors to be required or
19	19	suitable for the development, retention, or expansion of:
20	20	(A) manufacturing and industrial facilities;
21	21	(B) research and development facilities;
22	22	(C) military facilities, including closed or
23	23	realigned military bases;
24	24	(D) transportation facilities, including
25	25	airports, hangars, railports, rail switching facilities, [airport]
26	26	maintenance and repair facilities, [air] cargo facilities, related
27	27	infrastructure located on or adjacent to an airport or railport
28	28	facility, marine ports, inland ports, mass commuting facilities,
29	29	and parking facilities;
30	30	(E) sewage or solid waste disposal facilities;
31	31	(F) recycling facilities;
32	32	(G) air or water pollution control facilities;
33	33	(H) facilities for furnishing water to the
34	34	public;
35	35	(I) distribution centers;
36	36	(J) small warehouse facilities capable of
37	37	serving as decentralized storage and distribution centers;
38	38	(K) primary job training facilities for use by
39	39	institutions of higher education; or
40	40	(L) regional or national corporate headquarters
41	41	facilities.
42	42	SECTION 2. Section 505.1561, Local Government Code, as
43	43	effective September 1, 2009, is amended to read as follows:
44	44	Sec. 505.1561. PROJECTS RELATED TO AIRPORT FACILITIES IN
45	45	CERTAIN MUNICIPALITIES. For purposes of this chapter, "project"
46	46	includes land, buildings, equipment, facilities, and improvements
47	47	found by the board of directors to be required or suitable for the
48	48	development or expansion of airport or railport facilities,
49	49	including hangars, [airport] maintenance and repair facilities,
50	50	[air] cargo facilities, and related infrastructure located on or
51	51	adjacent to an airport or railport facility, if the project is
52	52	undertaken by a Type B corporation authorized to be created by a
53	53	municipality:
54	54	(1) that enters into a development agreement with an
55	55	entity in which the entity acquires a leasehold or other possessory
56	56	interest from the corporation and is authorized to sublease the
57	57	entity's interest for other projects authorized by Sections 505.151
58	58	through 505.156; and
59	59	(2) the governing body of which has authorized the
60	60	development agreement by adopting a resolution at a meeting called
61	61	as authorized by law.
62	62	SECTION 3. (a) In accordance with Section 311.031(c),
63	63	Government Code, which gives effect to a substantive amendment
64	64	enacted by the same legislature that codifies the amended statute,
65	65	the text of Sections 501.101 and 505.1561, Local Government Code,
66	66	as set out in this Act, give effect to changes made by Chapter 1102
67	67	(H.B. 3440), Acts of the 80th Legislature, Regular Session, 2007.
68	68	(b) To the extent of any conflict, this Act prevails over
69	69	another Act of the 81st Legislature, Regular Session, 2009,
70	70	relating to nonsubstantive additions to and corrections in enacted
71	71	codes.
72	72	SECTION 4. This Act takes effect September 1, 2009.
