77 relating to projects that may be undertaken by development
88 corporations for the development, retention, or expansion of
99 certain transportation facilities.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 501.101, Local Government Code, as
1212 effective September 1, 2009, is amended to read as follows:
1313 Sec. 501.101. PROJECTS RELATED TO CREATION OR RETENTION OF
1414 PRIMARY JOBS. In this subtitle, "project" includes the land,
1515 buildings, equipment, facilities, expenditures, targeted
1616 infrastructure, and improvements that are:
1717 (1) for the creation or retention of primary jobs; and
1818 (2) found by the board of directors to be required or
1919 suitable for the development, retention, or expansion of:
2020 (A) manufacturing and industrial facilities;
2121 (B) research and development facilities;
2222 (C) military facilities, including closed or
2323 realigned military bases;
2424 (D) transportation facilities, including
2525 airports, hangars, railports, rail switching facilities, [airport]
2626 maintenance and repair facilities, [air] cargo facilities, related
2727 infrastructure located on or adjacent to an airport or railport
2828 facility, marine ports, inland ports, mass commuting facilities,
2929 and parking facilities;
3030 (E) sewage or solid waste disposal facilities;
3131 (F) recycling facilities;
3232 (G) air or water pollution control facilities;
3333 (H) facilities for furnishing water to the
3434 public;
3535 (I) distribution centers;
3636 (J) small warehouse facilities capable of
3737 serving as decentralized storage and distribution centers;
3838 (K) primary job training facilities for use by
3939 institutions of higher education; or
4040 (L) regional or national corporate headquarters
4141 facilities.
4242 SECTION 2. Section 505.1561, Local Government Code, as
4343 effective September 1, 2009, is amended to read as follows:
4444 Sec. 505.1561. PROJECTS RELATED TO AIRPORT FACILITIES IN
4545 CERTAIN MUNICIPALITIES. For purposes of this chapter, "project"
4646 includes land, buildings, equipment, facilities, and improvements
4747 found by the board of directors to be required or suitable for the
4848 development or expansion of airport or railport facilities,
4949 including hangars, [airport] maintenance and repair facilities,
5050 [air] cargo facilities, and related infrastructure located on or
5151 adjacent to an airport or railport facility, if the project is
5252 undertaken by a Type B corporation authorized to be created by a
5353 municipality:
5454 (1) that enters into a development agreement with an
5555 entity in which the entity acquires a leasehold or other possessory
5656 interest from the corporation and is authorized to sublease the
5757 entity's interest for other projects authorized by Sections 505.151
5858 through 505.156; and
5959 (2) the governing body of which has authorized the
6060 development agreement by adopting a resolution at a meeting called
6161 as authorized by law.
6262 SECTION 3. (a) In accordance with Section 311.031(c),
6363 Government Code, which gives effect to a substantive amendment
6464 enacted by the same legislature that codifies the amended statute,
6565 the text of Sections 501.101 and 505.1561, Local Government Code,
6666 as set out in this Act, give effect to changes made by Chapter 1102
6767 (H.B. 3440), Acts of the 80th Legislature, Regular Session, 2007.
6868 (b) To the extent of any conflict, this Act prevails over
6969 another Act of the 81st Legislature, Regular Session, 2009,
7070 relating to nonsubstantive additions to and corrections in enacted
7171 codes.
7272 SECTION 4. This Act takes effect September 1, 2009.
