66 AN ACT
77 relating to the regulation of the maintenance of telephone and
88 electric utility poles.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Title 5, Utilities Code, is amended by adding
1111 Chapter 252 to read as follows:
1212 CHAPTER 252. UTILITY POLE SAFETY AND MAINTENANCE
1313 Sec. 252.001. MAINTENANCE OF UTILITY POLES. (a) An
1414 electric utility or telecommunications utility shall inspect:
1515 (1) each wooden transmission pole in the utility's
1616 service area for damage every two years;
1717 (2) each wooden distribution pole in the utility's
1818 service area for damage every eight years; and
1919 (3) transmission circuits each year.
2020 (b) On discovery of a damaged transmission or distribution
2121 pole, an electric utility or telecommunications utility shall
2222 replace the damaged pole with a metal pole.
2323 (c) An electric utility or telecommunications utility shall
2424 ensure that each utility pole located near a critical structure is a
2525 metal pole.
2626 (d) An electric utility or telecommunications utility shall
2727 perform:
2828 (1) an annual visual inspection of the utility's
2929 transmission system;
3030 (2) an annual infrared scan of the utility's
3131 transmission system;
3232 (3) an annual inspection of each distribution circuit;
3333 and
3434 (4) every five years, an inspection of the utility's
3535 distribution system.
3636 (e) An electric utility or telecommunications utility shall
3737 establish a vegetation management cycle for the clearing of trees,
3838 tree limbs, and other vegetative growth from utility line easements
3939 and utility structures:
4040 (1) annually, for vegetative growth located near a
4141 transmission circuit; and
4242 (2) every three years, for vegetative growth located
4343 near a distribution line.
4444 (f) The commission shall adopt rules to enforce this
4545 section.
4646 SECTION 2. This Act takes effect September 1, 2009.
