6	6	AN ACT
7	7	relating to the deposit of fees for oversize and overweight vehicle
8	8	permits in the state highway fund.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 622.051, Transportation Code, is amended
11	11	by adding Subsection (c) to read as follows:
12	12	(c) Fifty percent of a fee collected under Subsection (a)
13	13	shall be deposited to the credit of the state highway fund.
14	14	SECTION 2. Subchapter A, Chapter 623, Transportation Code,
15	15	is amended by adding Section 623.002 to read as follows:
16	16	Sec. 623.002. HALF OF FEES TO STATE HIGHWAY FUND.
17	17	Notwithstanding any other provision of this chapter to the
18	18	contrary, half of each fee collected under this chapter shall be
19	19	deposited to the credit of the state highway fund.
20	20	SECTION 3. Section 623.011, Transportation Code, is amended
21	21	by adding Subsection (h) to read as follows:
22	22	(h) Fifty percent of a fee collected under this section
23	23	shall be deposited to the credit of the state highway fund.
24	24	SECTION 4. Section 623.0111(c), Transportation Code, is
25	25	amended to read as follows:
26	26	(c) Fifty percent of a fee [Of the fees] collected under
27	27	Subsection (a) [the following amounts shall be deposited to the
28	28	general revenue fund and the remainder] shall be deposited to the
29	29	credit of the state highway fund.[:

48	48	SECTION 5. Section 623.096(b), Transportation Code, is
49	49	amended to read as follows:
50	50	(b) The department shall adopt rules concerning fees for
51	51	each annual permit issued under Section 623.095(c) at a cost not to
52	52	exceed $3,000. Fifty percent of the fee collected under this
53	53	subsection shall be deposited to the credit of the state highway
54	54	fund.
55	55	SECTION 6. This Act takes effect September 1, 2009.
