| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 1953.051, Insurance Code, as effective |
|---|
| 11 | 11 | | April 1, 2009, is amended to read as follows: |
|---|
| 12 | 12 | | Sec. 1953.051. EFFECT OF CERTAIN CONVICTIONS ON RATING |
|---|
| 13 | 13 | | [PLANS PROHIBITED]. (a) A rating plan regarding the writing of |
|---|
| 14 | 14 | | automobile insurance, including [other than] insurance written |
|---|
| 15 | 15 | | under Chapter 2151, may [not]: |
|---|
| 16 | 16 | | (1) assign a rate consequence to a charge or |
|---|
| 17 | 17 | | conviction for a violation of Subtitle C, Title 7, Transportation |
|---|
| 18 | 18 | | Code; or |
|---|
| 19 | 19 | | (2) otherwise cause premiums for automobile insurance |
|---|
| 20 | 20 | | to be increased because of a charge or conviction described by |
|---|
| 21 | 21 | | Subdivision (1). |
|---|
| 22 | 22 | | (b) The application of Subsection (a) may not result in an |
|---|
| 23 | 23 | | adverse rate consequence being assigned to or otherwise cause |
|---|
| 24 | 24 | | premiums for automobile insurance to be increased for an insured |
|---|
| 25 | 25 | | who does not have a conviction for a violation of Subtitle C, Title |
|---|
| 26 | 26 | | 7, Transportation Code. |
|---|
| 27 | 27 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 28 | 28 | | to an automobile insurance policy that is delivered, issued for |
|---|
| 29 | 29 | | delivery, or renewed on or after the effective date of this Act. An |
|---|
| 30 | 30 | | automobile insurance policy that is delivered, issued for delivery, |
|---|
| 31 | 31 | | or renewed before the effective date of this Act is covered by the |
|---|
| 32 | 32 | | law in effect at the time the policy was delivered, issued for |
|---|
| 33 | 33 | | delivery, or renewed, and that law is continued in effect for that |
|---|
| 34 | 34 | | purpose. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect September 1, 2009. |
