66 AN ACT
77 relating to the potential effect of certain convictions on
88 automobile insurance rates.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1953.051, Insurance Code, as effective
1111 April 1, 2009, is amended to read as follows:
1212 Sec. 1953.051. EFFECT OF CERTAIN CONVICTIONS ON RATING
1313 [PLANS PROHIBITED]. (a) A rating plan regarding the writing of
1414 automobile insurance, including [other than] insurance written
1515 under Chapter 2151, may [not]:
1616 (1) assign a rate consequence to a charge or
1717 conviction for a violation of Subtitle C, Title 7, Transportation
1818 Code; or
1919 (2) otherwise cause premiums for automobile insurance
2020 to be increased because of a charge or conviction described by
2121 Subdivision (1).
2222 (b) The application of Subsection (a) may not result in an
2323 adverse rate consequence being assigned to or otherwise cause
2424 premiums for automobile insurance to be increased for an insured
2525 who does not have a conviction for a violation of Subtitle C, Title
2626 7, Transportation Code.
2727 SECTION 2. The change in law made by this Act applies only
2828 to an automobile insurance policy that is delivered, issued for
2929 delivery, or renewed on or after the effective date of this Act. An
3030 automobile insurance policy that is delivered, issued for delivery,
3131 or renewed before the effective date of this Act is covered by the
3232 law in effect at the time the policy was delivered, issued for
3333 delivery, or renewed, and that law is continued in effect for that
3434 purpose.
3535 SECTION 3. This Act takes effect September 1, 2009.
