| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 19, Alcoholic Beverage Code, is amended |
|---|
| 11 | 11 | | by adding Section 19.011 to read as follows: |
|---|
| 12 | 12 | | Sec. 19.011. SALE TO CERTAIN PERMIT HOLDERS. The holder of |
|---|
| 13 | 13 | | a wholesaler's permit may sell ale, malt liquor, or wine to a |
|---|
| 14 | 14 | | private club registration permit holder whose premises are located |
|---|
| 15 | 15 | | in an area where the sale of the ale, malt liquor, or wine has been |
|---|
| 16 | 16 | | authorized. |

| 17 | 17 | | SECTION 2. Chapter 20, Alcoholic Beverage Code, is amended |
|---|
| 18 | 18 | | by adding Section 20.011 to read as follows: |
|---|
| 19 | 19 | | Sec. 20.011. SALE TO CERTAIN PERMIT HOLDERS. The holder of |
|---|
| 20 | 20 | | a general class B wholesaler's permit may sell ale, malt liquor, or |
|---|
| 21 | 21 | | wine to a private club registration permit holder whose premises |
|---|
| 22 | 22 | | are located in an area where the sale of the ale, malt liquor, or |
|---|
| 23 | 23 | | wine has been authorized. |

| 24 | 24 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2009. |
