66 AN ACT
77 relating to the regulation of smoking in eating and drinking places
88 in certain areas of the state; providing penalties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 109, Alcoholic Beverage Code, is amended
1111 by adding Subchapter E to read as follows:
1212 SUBCHAPTER E. SMOKING PROHIBITED IN CERTAIN EATING AND DRINKING
1313 PLACES
1414 Sec. 109.71. DEFINITIONS. In this subchapter:
1515 (1) "Cigar bar" means a business that:
1616 (A) has less than 15 percent of gross sales in
1717 tobacco products, as that term is defined by Section 155.001, Tax
1818 Code;
1919 (B) holds a permit under Chapter 155, Tax Code;
2020 and
2121 (C) holds an alcoholic beverage permit or license
2222 under Chapter 25, 28, 32, or 69 originally issued before June 1,
2323 2009.
2424 (2) "Eating and drinking place" means an establishment
2525 that holds a permit or license issued under Chapter 25, 28, 32, or
2626 69.
2727 (3) "Enclosed area" means all space between a floor
2828 and ceiling that is enclosed on all sides by solid walls or windows,
2929 exclusive of doorways, which extend from the floor to the ceiling.
3030 (4) "Smoke" means to inhale or exhale smoke from,
3131 burn, or carry a lighted cigar, cigarette, pipe, or other smoking
3232 equipment in any manner.
3333 Sec. 109.72. SMOKING PROHIBITED. A person may not smoke:
3434 (1) in the enclosed area of an eating and drinking
3535 place; or
3636 (2) within 15 feet of the primary entrance to an eating
3737 and drinking place.
3838 Sec. 109.73. EXCEPTIONS. This subchapter does not apply to
3939 a cigar bar or a fraternal or veterans organization as described by
4040 Section 32.11.
4141 Sec. 109.74. DUTIES OF PERSON IN CONTROL OF AN EATING AND
4242 DRINKING PLACE. A person in control of an eating and drinking place
4343 shall:
4444 (1) post clearly and conspicuously in a manner
4545 reasonably necessary to give notice to persons entering the eating
4646 and drinking place:
4747 (A) a sign with the words "NO SMOKING"; or
4848 (B) a sign with the international no smoking
4949 symbol depicting a burning cigarette overlaid by a red circle with a
5050 diagonal line across the cigarette; and
5151 (2) remove all ashtrays from any area where smoking is
5252 prohibited.
5353 Sec. 109.75. ENFORCEMENT. (a) The commission or another
5454 state agency or a political subdivision of the state may enforce
5555 this subchapter.
5656 (b) In enforcing this subchapter the commission or another
5757 state agency or a political subdivision of the state may enter and
5858 inspect an eating and drinking place.
5959 (c) A person may file a complaint concerning a violation of
6060 this subchapter with the commission or a political subdivision of
6161 the state.
6262 Sec. 109.76. INJUNCTIVE RELIEF. In addition to the other
6363 remedies provided by this subchapter, the attorney general or a
6464 district, county, or city attorney may bring an action for
6565 injunctive relief to enforce this subchapter.
6666 Sec. 109.77. OFFENSES; PENALTIES. (a) A person who
6767 violates Section 109.72 or 109.74 commits an offense. An offense
6868 under this subsection is a misdemeanor punishable by a fine not to
6969 exceed $100.
7070 (b) If it is shown on the trial of an offense under
7171 Subsection (a) that the defendant has previously been finally
7272 convicted of an offense under that subsection that occurred within
7373 one year before the date of the offense that is the subject of the
7474 trial, on conviction the defendant shall be punished by a fine not
7575 to exceed $500.
7676 (c) If it is shown on the trial of an offense under
7777 Subsection (a) that the defendant has previously been finally
7878 convicted of two offenses under that subsection that occurred
7979 within one year before the date of the offense that is the subject
8080 of the trial, on conviction the defendant shall be punished by a
8181 fine not to exceed $1,000.
8282 Sec. 109.78. SEPARATE VIOLATIONS. Each day on which a
8383 violation of this subchapter occurs is considered a separate
8484 violation.
8585 Sec. 109.79. APPLICABILITY; CONSTRUCTION. (a) This
8686 subchapter applies only to an eating or drinking place located in a
8787 county with a population of more than 400,000.
8888 (b) This subchapter preempts and supersedes a local
8989 ordinance, rule, or regulation adopted by any political subdivision
9090 that restricts or prohibits smoking on the premises of an eating and
9191 drinking place in a county subject to this subchapter.
9292 SECTION 2. This Act takes effect only if neither Senate Bill
9393 No. 544 nor House Bill No. 5 of the Regular Session of the 81st
9494 Legislature, prohibiting smoking in certain public places and
9595 places of employment, becomes law. If Senate Bill No. 544 or House
9696 Bill No. 5, prohibiting smoking in certain public places and places
9797 of employment, becomes law, this Act has no effect.
9898 SECTION 3. This Act takes effect September 1, 2009.
