| 8 | 8 | | state that is not an initial party state to the Texas Low-Level |

| 9 | 9 | | Radioactive Waste Disposal Compact. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 401.207, Health and Safety Code, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | Sec. 401.207. OUT-OF-STATE WASTE. The compact waste |
|---|
| 14 | 14 | | disposal facility license holder may not accept low-level |
|---|
| 15 | 15 | | radioactive waste generated in another state for disposal under a |
|---|
| 16 | 16 | | license issued by the commission unless the waste is: |
|---|
| 17 | 17 | | (1) accepted from a state: |
|---|
| 18 | 18 | | (A) that was an initial party state to the [under |
|---|
| 19 | 19 | | a] compact under Section 403.006; or |
|---|
| 20 | 20 | | (B) that is a state: |
|---|
| 21 | 21 | | (i) added to the compact as a party under |
|---|
| 22 | 22 | | Section 403.006 in accordance with the terms of the compact; and |
|---|
| 23 | 23 | | (ii) by statute expressly authorized to |
|---|
| 24 | 24 | | send low-level radioactive waste to the compact waste disposal |
|---|
| 25 | 25 | | facility for disposal under the license [to which the state is a |
|---|
| 26 | 26 | | contracting party]; |
|---|
| 27 | 27 | | (2) federal facility waste that the license holder is |
|---|
| 28 | 28 | | licensed to dispose of under Section 401.216; or |
|---|
| 29 | 29 | | (3) generated from manufactured sources or devices |
|---|
| 30 | 30 | | originating in this state. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2009. |
