66 AN ACT
77 relating to the disposal of low-level radioactive waste from a
88 state that is not an initial party state to the Texas Low-Level
99 Radioactive Waste Disposal Compact.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 401.207, Health and Safety Code, is
1212 amended to read as follows:
1313 Sec. 401.207. OUT-OF-STATE WASTE. The compact waste
1414 disposal facility license holder may not accept low-level
1515 radioactive waste generated in another state for disposal under a
1616 license issued by the commission unless the waste is:
1717 (1) accepted from a state:
1818 (A) that was an initial party state to the [under
1919 a] compact under Section 403.006; or
2020 (B) that is a state:
2121 (i) added to the compact as a party under
2222 Section 403.006 in accordance with the terms of the compact; and
2323 (ii) by statute expressly authorized to
2424 send low-level radioactive waste to the compact waste disposal
2525 facility for disposal under the license [to which the state is a
2626 contracting party];
2727 (2) federal facility waste that the license holder is
2828 licensed to dispose of under Section 401.216; or
2929 (3) generated from manufactured sources or devices
3030 originating in this state.
3131 SECTION 2. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2009.
