66 AN ACT
77 relating to the development and use of an inmate skills development
88 assessment instrument by the Texas Department of Criminal Justice.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 493, Government Code, is amended by
1111 adding Section 493.032 to read as follows:
1212 Sec. 493.032. SKILLS DEVELOPMENT ASSESSMENT. (a) The
1313 department shall develop an inmate skills development assessment
1414 instrument to evaluate the functional capacity of an inmate in the
1515 following areas:
1616 (1) academic ability, including intellectual
1717 functioning, literacy, and language skills;
1818 (2) vocational and career development, including
1919 employment history, career development, institutional work
2020 history, and prospects for post-incarceration employment;
2121 (3) establishing and maintaining interpersonal
2222 relationships, including the existence of any ongoing contact with
2323 family members or other support systems, the ability to fulfill
2424 parental responsibilities and duties, and communication skills;
2525 (4) wellness maintenance, including health promotion
2626 and disease prevention, disease and illness management, and
2727 knowledge concerning eligibility for and procedures for obtaining
2828 governmental assistance;
2929 (5) mental health maintenance, including substance
3030 abuse management, mental illness management, and the ability to
3131 identify and manage inappropriate sexual behavior;
3232 (6) general behavior, including cognitive behavior,
3333 criminal behavior and history, and history of domestic violence or
3434 other abuse;
3535 (7) character, including personal characteristics and
3636 personal responsibilities;
3737 (8) leisure activities, including the appropriate use
3838 of leisure time; and
3939 (9) skills needed in daily life, including financial
4040 management, the ability to secure and maintain housing, and skills
4141 needed to care for one's family.
4242 (b) The department shall consult with the Texas
4343 Correctional Office on Offenders with Medical and Mental
4444 Impairments, the Department of State Health Services, the
4545 Department of Assistive and Rehabilitative Services, and the Texas
4646 Workforce Commission in developing the inmate skills development
4747 assessment instrument under Subsection (a).
4848 (c) The department shall:
4949 (1) not later than the 90th day after the date an
5050 inmate is placed in the custody of the department, evaluate the
5151 inmate using the inmate skills development assessment instrument
5252 developed under Subsection (a);
5353 (2) use the inmate skills development assessment
5454 instrument under Subsection (a) as a guide in deciding the
5555 rehabilitative services and programs in which to place an inmate;
5656 (3) maintain a record for each inmate of the results of
5757 any inmate skills development assessment administered under this
5858 section;
5959 (4) not later than the 90th day before any release or
6060 discharge date applicable to an inmate, reevaluate the inmate using
6161 the inmate skills development assessment instrument to prepare a
6262 post-incarceration transition plan for the inmate; and
6363 (5) as soon as practicable after the reevaluation of
6464 an inmate under Subdivision (4) and not later than the 30th day
6565 before any release or discharge date applicable to an inmate,
6666 provide the results of the reevaluation and the post-incarceration
6767 transition plan to any reentry or reintegration office operated by
6868 the county or municipality into which the inmate will be released or
6969 discharged.
7070 (d) The department may periodically reevaluate an inmate
7171 using the inmate skills development assessment instrument to
7272 determine the inmate's progress in skill development and, if
7373 necessary, to place the inmate in different rehabilitative services
7474 and programs.
7575 SECTION 2. The Texas Department of Criminal Justice shall
7676 develop the inmate skills development assessment instrument as
7777 required by Section 493.032, Government Code, as added by this Act,
7878 not later than April 1, 2010.
7979 SECTION 3. This Act takes effect September 1, 2009.
