9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 9.004(a), Local Government Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | (a) The governing body of a municipality on its own motion | |
13 | 13 | may submit a proposed charter amendment to the municipality's | |
14 | 14 | qualified voters for their approval at an election. The governing | |
15 | 15 | body shall submit a proposed charter amendment to the voters for | |
16 | 16 | their approval at an election if the submission is supported by a | |
17 | 17 | petition signed by a number of registered [qualified] voters of the | |
18 | 18 | municipality equal to at least 10 [five] percent of the number of | |
19 | 19 | registered [qualified] voters of the municipality [or 20,000, | |
20 | 20 | whichever number is the smaller]. The petition requirements of | |
21 | 21 | this subsection do not affect a petition submitted under Chapter | |
22 | 22 | 143 or 174. | |
23 | 23 | SECTION 2. The change in law made by this Act applies only | |
24 | 24 | to a petition proposing a charter amendment that is filed with a | |
25 | 25 | municipality on or after September 1, 2009. | |
26 | 26 | SECTION 3. This Act takes effect September 1, 2009. |
