| 5 | 5 | | relating to the enforcement of certain development regulations in a |

| 6 | 6 | | justice court. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 231.229(b), Local Government Code, is |
|---|
| 9 | 9 | | amended to read as follows: |
|---|
| 10 | 10 | | (b) A person commits an offense if the person violates this |
|---|
| 11 | 11 | | subchapter or an order or development regulation adopted under this |
|---|
| 12 | 12 | | subchapter. An offense under this subsection is a misdemeanor |
|---|
| 13 | 13 | | punishable by a fine of not less than $500 or more than $1,000. Each |
|---|
| 14 | 14 | | day that a violation occurs constitutes a separate offense. Trial |
|---|
| 15 | 15 | | shall be in the justice [district] court. |
|---|
| 16 | 16 | | SECTION 2. Section 231.229, Local Government Code, as |
|---|
| 17 | 17 | | amended by this Act, applies to an offense committed on or after the |
|---|
| 18 | 18 | | effective date of this Act. An offense committed before the |
|---|
| 19 | 19 | | effective date of this Act is governed by the law in effect when the |
|---|
| 20 | 20 | | offense was committed, and the former law is continued in effect for |
|---|
| 21 | 21 | | that purpose. |

| 22 | 22 | | SECTION 3. This Act takes effect September 1, 2009. |
