| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 483.001(12), Health and Safety Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (12) "Practitioner" means a person licensed: |
|---|
| 13 | 13 | | (A) by the Texas State Board of Medical |
|---|
| 14 | 14 | | Examiners, State Board of Dental Examiners, Texas State Board of |
|---|
| 15 | 15 | | Podiatric Medical Examiners, Texas Optometry Board, Texas State |
|---|
| 16 | 16 | | Board of Acupuncture Examiners, Texas Board of Chiropractic |
|---|
| 17 | 17 | | Examiners, Texas State Board of Examiners of Professional |
|---|
| 18 | 18 | | Counselors, Texas State Board of Examiners of Psychologists, or |
|---|
| 19 | 19 | | State Board of Veterinary Medical Examiners to prescribe and |
|---|
| 20 | 20 | | administer dangerous drugs; |
|---|
| 21 | 21 | | (B) by another state in a health field in which, |
|---|
| 22 | 22 | | under the laws of this state, a licensee may legally prescribe |
|---|
| 23 | 23 | | dangerous drugs; |
|---|
| 24 | 24 | | (C) in Canada or Mexico in a health field in |
|---|
| 25 | 25 | | which, under the laws of this state, a licensee may legally |
|---|
| 26 | 26 | | prescribe dangerous drugs; or |
|---|
| 27 | 27 | | (D) an advanced practice nurse or physician |
|---|
| 28 | 28 | | assistant to whom a physician has delegated the authority to carry |
|---|
| 29 | 29 | | out or sign prescription drug orders under Section 157.0511, |
|---|
| 30 | 30 | | 157.052, 157.053, 157.054, 157.0541, or 157.0542, Occupations |
|---|
| 31 | 31 | | Code. |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2009. |
