55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to persons considered practitioners for purposes of
88 prescribing certain drugs and devices.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 483.001(12), Health and Safety Code, is
1111 amended to read as follows:
1212 (12) "Practitioner" means a person licensed:
1313 (A) by the Texas State Board of Medical
1414 Examiners, State Board of Dental Examiners, Texas State Board of
1515 Podiatric Medical Examiners, Texas Optometry Board, Texas State
1616 Board of Acupuncture Examiners, Texas Board of Chiropractic
1717 Examiners, Texas State Board of Examiners of Professional
1818 Counselors, Texas State Board of Examiners of Psychologists, or
1919 State Board of Veterinary Medical Examiners to prescribe and
2020 administer dangerous drugs;
2121 (B) by another state in a health field in which,
2222 under the laws of this state, a licensee may legally prescribe
2323 dangerous drugs;
2424 (C) in Canada or Mexico in a health field in
2525 which, under the laws of this state, a licensee may legally
2626 prescribe dangerous drugs; or
2727 (D) an advanced practice nurse or physician
2828 assistant to whom a physician has delegated the authority to carry
2929 out or sign prescription drug orders under Section 157.0511,
3030 157.052, 157.053, 157.054, 157.0541, or 157.0542, Occupations
3131 Code.
3232 SECTION 2. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2009.
