66 AN ACT
77 relating to the establishment of railroad quiet zones outside the
88 boundaries of certain municipalities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 311, Transportation Code,
1111 is amended by adding Section 311.054 to read as follows:
1212 Sec. 311.054. RAILROAD QUIET ZONE LOCATED OUTSIDE TYPE A
1313 GENERAL-LAW MUNICIPALITY. (a) This section applies only to a Type
1414 A general-law municipality that is an enclave surrounded entirely
1515 by a municipality with a population of 1.1 million or more.
1616 (b) The governing body of the general-law municipality may
1717 enter into an interlocal contract with the surrounding municipality
1818 for the establishment of a railroad quiet zone located outside the
1919 boundaries of the general-law municipality that the governing body
2020 determines will benefit the general-law municipality.
2121 (c) A general-law municipality may expend municipal funds
2222 and may issue certificates of obligation or bonds to pay for
2323 expenses associated with a railroad quiet zone under Subsection
2424 (b), including expenses related to feasibility, engineering, and
2525 traffic studies and improvements related to the railroad quiet
2626 zone.
2727 SECTION 2. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2009.
