9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter C, Chapter 311, Transportation Code, |
---|
11 | 11 | | is amended by adding Section 311.054 to read as follows: |

12 | 12 | | Sec. 311.054. RAILROAD QUIET ZONE LOCATED OUTSIDE TYPE A |
---|
13 | 13 | | GENERAL-LAW MUNICIPALITY. (a) This section applies only to a Type |
---|
14 | 14 | | A general-law municipality that is an enclave surrounded entirely |
---|
15 | 15 | | by a municipality with a population of 1.1 million or more. |
---|
16 | 16 | | (b) The governing body of the general-law municipality may |
---|
17 | 17 | | enter into an interlocal contract with the surrounding municipality |
---|
18 | 18 | | for the establishment of a railroad quiet zone located outside the |
---|
19 | 19 | | boundaries of the general-law municipality that the governing body |
---|
20 | 20 | | determines will benefit the general-law municipality. |
---|
21 | 21 | | (c) A general-law municipality may expend municipal funds |
---|
22 | 22 | | and may issue certificates of obligation or bonds to pay for |
---|
23 | 23 | | expenses associated with a railroad quiet zone under Subsection |
---|
24 | 24 | | (b), including expenses related to feasibility, engineering, and |
---|
25 | 25 | | traffic studies and improvements related to the railroad quiet |
---|
26 | 26 | | zone. |
---|
27 | 27 | | SECTION 2. This Act takes effect immediately if it receives |
---|
28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
---|
29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
---|
31 | 31 | | Act takes effect September 1, 2009. |
