55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to certain illegal pricing practices.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 552.003(a), Insurance Code, is amended
1010 to read as follows:
1111 (a) A person commits an offense if:
1212 (1) the person knowingly or intentionally charges two
1313 different prices, including contractual allowances, for providing
1414 the same product or service; and
1515 (2) the higher price charged, including contractual
1616 allowances, is based on the fact that an insurer or its insured will
1717 pay all or part of the price of the product or service.
1818 SECTION 2. The change in law made by this Act applies only
1919 to an offense committed on or after the effective date of this Act.
2020 An offense committed before the effective date of this Act is
2121 governed by the law in effect at the time the offense was committed,
2222 and the former law is continued in effect for that purpose. For the
2323 purposes of this section, an offense was committed before the
2424 effective date of this Act if any element of the offense occurred
2525 before that date.
2626 SECTION 3. This Act takes effect September 1, 2009.
