55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to indigent health care.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. The legislature recognizes that this state has a
1010 responsibility to ensure that indigent residents who do not have
1111 health insurance, cannot afford to pay for health care, and do not
1212 qualify for medical assistance through the state or federal
1313 government have access to the basic services necessary to maintain
1414 good health.
1515 SECTION 2. (a) The executive commissioner of the Health and
1616 Human Services Commission shall adopt rules relating to improving
1717 the indigent health care services provided throughout this state,
1818 including rules relating to:
1919 (1) contracts with health care entities for provision
2020 of indigent health care services;
2121 (2) requiring health care facilities, including
2222 public and private hospitals, to implement an indigent health care
2323 program in accordance with standards developed by the executive
2424 commissioner;
2525 (3) expanding eligibility for indigent health care
2626 services by various methods, including raising the income level for
2727 eligibility;
2828 (4) maximizing available state and federal funding to
2929 be used for provision of indigent health care, including federal
3030 stimulus money and money for health care information technology;
3131 (5) utilizing available private funding for provision
3232 of indigent health care;
3333 (6) increasing spending on indigent health care by
3434 matching county funds with state funds;
3535 (7) expanding the range of services offered to
3636 indigent patients through an indigent health care program,
3737 including dental services, physical therapy, and occupational
3838 therapy;
3939 (8) increasing access to preventative treatment,
4040 including dental treatment, vaccinations, regular physical
4141 examinations, and routine screenings for health conditions, to
4242 lower the cost of emergency treatment;
4343 (9) developing incentives for providers of indigent
4444 health care to provide a wider variety of optional services;
4545 (10) regulations for federally qualified health
4646 centers to assist those entities in providing indigent health care
4747 as efficiently as possible;
4848 (11) outcome-based performance standards for indigent
4949 health care designed to improve the quality of care and lower the
5050 cost of care;
5151 (12) educational programs to assist a recipient of
5252 indigent health care to enroll in any health-related program
5353 administered by this state or the federal government for which the
5454 person is eligible;
5555 (13) improving the communication between providers,
5656 health care facilities, and the Department of State Health Services
5757 to enable an appropriate response to issues as they arise;
5858 (14) utilizing existing resources to their greatest
5959 potential, including the county indigent health care program of the
6060 Department of State Health Services;
6161 (15) requiring the evaluation of state indigent health
6262 care services and recommendations for improvement by state
6363 agencies, educational institutions, or independent research
6464 entities;
6565 (16) identifying best practices for provision of care;
6666 and
6767 (17) establishing long-term goals for the provision of
6868 indigent health care services.
6969 (b) Notwithstanding Chapter 61, Health and Safety Code, or
7070 any other law regarding the provision of health care services to
7171 persons who are uninsured or otherwise unable to afford to pay for
7272 health care services, the Department of State Health Services shall
7373 implement the rules adopted under Subsection (a).
7474 SECTION 3. This Act takes effect September 1, 2009.
