66 AN ACT
77 relating to the procedures for certain honorably retired peace
88 officers to maintain a license to carry a concealed handgun.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 411.199(a) and (e), Government Code,
1111 are amended to read as follows:
1212 (a) A person who is licensed as a peace officer under
1313 Chapter 1701, Occupations Code, [Chapter 415] and who has been
1414 employed full-time as a peace officer by a law enforcement agency
1515 may apply for a license under this subchapter at any time after
1616 retirement.
1717 (e) A retired peace officer who obtains a license under this
1818 subchapter must maintain, for the category of weapon licensed, the
1919 proficiency required for a peace officer under Section 1701.355,
2020 Occupations Code [Section 415.035]. The department [or a local law
2121 enforcement agency] shall allow a retired peace officer of the
2222 department [or agency] an opportunity to annually demonstrate the
2323 required proficiency. A local law enforcement agency shall allow a
2424 retired peace officer of the agency, or a retired peace officer who
2525 resides in the jurisdiction of the agency, an opportunity to
2626 annually demonstrate the required proficiency. The proficiency
2727 shall be reported to the department on application and renewal.
2828 SECTION 2. This Act takes effect September 1, 2009.
