| 7 | 7 | | relating to the procedures for certain honorably retired peace |

| 8 | 8 | | officers to maintain a license to carry a concealed handgun. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 411.199(a) and (e), Government Code, |
|---|
| 11 | 11 | | are amended to read as follows: |
|---|
| 12 | 12 | | (a) A person who is licensed as a peace officer under |
|---|
| 13 | 13 | | Chapter 1701, Occupations Code, [Chapter 415] and who has been |
|---|
| 14 | 14 | | employed full-time as a peace officer by a law enforcement agency |
|---|
| 15 | 15 | | may apply for a license under this subchapter at any time after |
|---|
| 16 | 16 | | retirement. |
|---|
| 17 | 17 | | (e) A retired peace officer who obtains a license under this |
|---|
| 18 | 18 | | subchapter must maintain, for the category of weapon licensed, the |
|---|
| 19 | 19 | | proficiency required for a peace officer under Section 1701.355, |
|---|
| 20 | 20 | | Occupations Code [Section 415.035]. The department [or a local law |
|---|
| 21 | 21 | | enforcement agency] shall allow a retired peace officer of the |
|---|
| 22 | 22 | | department [or agency] an opportunity to annually demonstrate the |
|---|
| 23 | 23 | | required proficiency. A local law enforcement agency shall allow a |
|---|
| 24 | 24 | | retired peace officer of the agency, or a retired peace officer who |
|---|
| 25 | 25 | | resides in the jurisdiction of the agency, an opportunity to |
|---|
| 26 | 26 | | annually demonstrate the required proficiency. The proficiency |
|---|
| 27 | 27 | | shall be reported to the department on application and renewal. |
|---|
| 28 | 28 | | SECTION 2. This Act takes effect September 1, 2009. |
