| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 302.001, Business & Commerce Code, as |
|---|
| 10 | 10 | | effective April 1, 2009, is amended by adding Subdivisions (1-a) |
|---|
| 11 | 11 | | and (8) to read as follows: |
|---|
| 12 | 12 | | (1-a) "List owner" means a person who possesses a |
|---|
| 13 | 13 | | proprietary interest in a telephone solicitation list. |
|---|
| 14 | 14 | | (8) "Telephone solicitation list" means a collection |
|---|
| 15 | 15 | | of telephone numbers or telephone numbers in combination with names |
|---|
| 16 | 16 | | or addresses that are used to make telephone solicitations. |

| 17 | 17 | | SECTION 2. Subchapter A, Chapter 302, Business & Commerce |
|---|
| 18 | 18 | | Code, as effective April 1, 2009, is amended by adding Section |
|---|
| 19 | 19 | | 302.005 to read as follows: |
|---|
| 20 | 20 | | Sec. 302.005. SOLICITATION LIST; PROPRIETARY INFORMATION. |
|---|
| 21 | 21 | | A telephone solicitation list provided to a third party in |
|---|
| 22 | 22 | | connection with a telephone solicitation that is to be initiated by |
|---|
| 23 | 23 | | the third party on the list owner's behalf is the proprietary and |
|---|
| 24 | 24 | | confidential information of the list owner. The third party may not |
|---|
| 25 | 25 | | disclose, duplicate, reuse, sell, transfer, or otherwise reproduce |
|---|
| 26 | 26 | | or retain the telephone solicitation list in any form. |
|---|
| 27 | 27 | | SECTION 3. The change in law made by this Act applies to a |
|---|
| 28 | 28 | | telephone solicitation list provided to a third party without |
|---|
| 29 | 29 | | regard to whether the list is provided before, on, or after the |
|---|
| 30 | 30 | | effective date of this Act. |
|---|
| 31 | 31 | | SECTION 4. This Act takes effect September 1, 2009. |
