9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter F, Chapter 813, Government Code, is | |
11 | 11 | amended by adding Section 813.5061 to read as follows: | |
12 | 12 | Sec. 813.5061. TREATMENT OF PRIOR SERVICE CREDIT OF CERTAIN | |
13 | 13 | MEMBERS AS CUSTODIAL OFFICER SERVICE. (a) A member of the | |
14 | 14 | retirement system who is employed by the Board of Pardons and | |
15 | 15 | Paroles or the Texas Department of Criminal Justice as a parole | |
16 | 16 | officer is entitled to establish service credit as a custodial | |
17 | 17 | officer in the retirement system for service performed as a parole | |
18 | 18 | officer before September 1, 1999. | |
19 | 19 | (b) The board of trustees with the assistance of the Board | |
20 | 20 | of Pardons and Paroles and the Texas Department of Criminal Justice | |
21 | 21 | shall adopt rules to implement and administer this section. | |
22 | 22 | SECTION 2. This Act takes effect immediately if it receives | |
23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
26 | 26 | Act takes effect September 1, 2009. |
