66 AN ACT
77 relating to credit in the Employees Retirement System of Texas for
88 service as a custodial officer.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter F, Chapter 813, Government Code, is
1111 amended by adding Section 813.5061 to read as follows:
1212 Sec. 813.5061. TREATMENT OF PRIOR SERVICE CREDIT OF CERTAIN
1313 MEMBERS AS CUSTODIAL OFFICER SERVICE. (a) A member of the
1414 retirement system who is employed by the Board of Pardons and
1515 Paroles or the Texas Department of Criminal Justice as a parole
1616 officer is entitled to establish service credit as a custodial
1717 officer in the retirement system for service performed as a parole
1818 officer before September 1, 1999.
1919 (b) The board of trustees with the assistance of the Board
2020 of Pardons and Paroles and the Texas Department of Criminal Justice
2121 shall adopt rules to implement and administer this section.
2222 SECTION 2. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2009.
