| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 493.007, Government Code, is amended by |
|---|
| 12 | 12 | | amending Subsection (a) and adding Subsection (e) to read as |
|---|
| 13 | 13 | | follows: |
|---|
| 14 | 14 | | (a) The executive director shall develop an intraagency |
|---|
| 15 | 15 | | career ladder program. The career ladder program developed under |
|---|
| 16 | 16 | | this subsection must include prison industry workers. The program |
|---|
| 17 | 17 | | must [shall] require intraagency postings of all nonentry level |
|---|
| 18 | 18 | | positions concurrently with any public postings. |
|---|
| 19 | 19 | | (e) In this section, "prison industry worker" means a |
|---|
| 20 | 20 | | department employee, other than a correctional officer, who is |
|---|
| 21 | 21 | | assigned to work on a program or project established under Chapter |
|---|
| 22 | 22 | | 497 and whose job on a regular basis requires routine contact with |
|---|
| 23 | 23 | | state jail defendants or inmates confined in facilities operated by |
|---|
| 24 | 24 | | or under contract with the department. The term includes a farm |
|---|
| 25 | 25 | | manager, livestock supervisor, maintenance foreman, shop foreman, |
|---|
| 26 | 26 | | medical assistant, food service supervisor, steward, education |
|---|
| 27 | 27 | | consultant, commodity specialist, truck driver, or correctional |
|---|
| 28 | 28 | | counselor. |
|---|
| 29 | 29 | | SECTION 2. The Texas Department of Criminal Justice shall |
|---|
| 30 | 30 | | use the career ladder program developed under Section 493.007(a), |
|---|
| 31 | 31 | | Government Code, as amended by this Act, for any person who becomes |
|---|
| 32 | 32 | | employed by the department as a prison industry worker or who |
|---|
| 33 | 33 | | becomes eligible for promotion by the department as a prison |
|---|
| 34 | 34 | | industry worker on or after the effective date of this Act. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect September 1, 2009. |
