88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 5.008(b), Property Code, as amended by
1010 Chapters 448 (H.B. 271), 1051 (H.B. 2118), and 1256 (H.B. 2819),
1111 Acts of the 80th Legislature, Regular Session, 2007, is reenacted
1212 and amended to read as follows:
1313 (b) The notice must be executed and must, at a minimum, read

118118 one-family or two-family dwellings to have working smoke detectors
119119 installed in accordance with the requirements of the building code
120120 in effect in the area in which the dwelling is located, including
121121 performance, location, and power source requirements. If you do
122122 not know the building code requirements in effect in your area, you

124124 more information. A buyer may require a seller to install smoke
125125 detectors for the hearing impaired if: (1) the buyer or a member of
126126 the buyer's family who will reside in the dwelling is hearing
127127 impaired; (2) the buyer gives the seller written evidence of the
128128 hearing impairment from a licensed physician; and (3) within 10
129129 days after the effective date, the buyer makes a written request for
130130 the seller to install smoke detectors for the hearing impaired and
131131 specifies the locations for installation. The parties may agree who
132132 will bear the cost of installing the smoke detectors and which brand
133133 of smoke detectors to install.

247247 SECTION 2. The change in law made by this Act to Section
248248 5.008, Property Code, applies only to a notice executed on or after
249249 the effective date of this Act. A notice executed before the
250250 effective date of this Act is governed by the law in effect

252252 for that purpose.
253253 SECTION 3. This Act takes effect January 1, 2010.
