7 | 7 | | relating to the participation of certain retirees under the |

8 | 8 | | proportionate retirement program in the Texas Public School |

9 | 9 | | Employees Group Benefits Program. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 803.201(b), Government Code, is amended |
---|
12 | 12 | | to read as follows: |
---|
13 | 13 | | (b) Except as provided by Section 1575.004(d), Insurance |
---|
14 | 14 | | Code, a [A] person's combined service credit is useable only in |
---|
15 | 15 | | determining eligibility for service retirement benefits and may not |
---|
16 | 16 | | be used in determining: |
---|
17 | 17 | | (1) eligibility for disability retirement benefits, |
---|
18 | 18 | | death benefits, or any type of benefit other than service |
---|
19 | 19 | | retirement benefits; nor |
---|
20 | 20 | | (2) the amount of any type of benefit. |
---|
21 | 21 | | SECTION 2. Section 1575.004, Insurance Code, is amended by |
---|
22 | 22 | | adding Subsection (d) to read as follows: |
---|
23 | 23 | | (d) For purposes of determining the years of service credit |
---|
24 | 24 | | of an individual under Subsection (a)(1)(A) or (a)(1)(B)(ii) who |
---|
25 | 25 | | has at least 15 years of service credit in the Teacher Retirement |
---|
26 | 26 | | System of Texas, all of the individual's combined service credit as |
---|
27 | 27 | | determined under Chapter 803, Government Code, but not to exceed 10 |
---|
28 | 28 | | years of credit, shall be considered as if it were credited to the |
---|
29 | 29 | | Teacher Retirement System of Texas. |
---|
30 | 30 | | SECTION 3. The change in law made by this Act applies to an |
---|
31 | 31 | | individual without regard to whether the individual retires before, |
---|
32 | 32 | | on, or after the effective date of this Act. |
---|
33 | 33 | | SECTION 4. This Act takes effect September 1, 2009. |
