66 AN ACT
77 relating to the creation of the Public Education Management
88 Institute of Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 96, Education Code, is
1111 amended by adding Section 96.66 to read as follows:
1212 Sec. 96.66. PUBLIC EDUCATION MANAGEMENT INSTITUTE OF TEXAS.
1313 (a) In this section:
1414 (1) "Fund" means the Public Education Management
1515 Institute of Texas fund.
1616 (2) "Institute" means the Public Education Management
1717 Institute of Texas.
1818 (3) "Public school administrator" means a person who
1919 holds or seeks employment with a school district for which the
2020 person is required to be certified as an administrator under
2121 Subchapter B, Chapter 21.
2222 (b) The Public Education Management Institute of Texas is
2323 created for the training of public school administrators. The
2424 headquarters of the institute are at Sam Houston State University.
2525 The institute is under the supervision and direction of the
2626 president of Sam Houston State University and shall be operated and
2727 managed as a joint program among Sam Houston State University, the
2828 University of North Texas, and Texas State University--San Marcos.
2929 (c) Any public school administrator in this state, whether
3030 or not the person is sponsored by an employing school district, may
3131 participate in an institute training program. The costs of
3232 participating in an institute training program by a person who is a
3333 resident of this state, including the costs of tuition, books,
3434 room, board, and travel, shall be paid from the fund. The president
3535 of Sam Houston State University shall establish reasonable charges
3636 for participation in an institute training program by a person who
3737 is not a resident of this state.
3838 (d) The fund is in the state treasury. The president of Sam
3939 Houston State University shall use the fund in administering the
4040 institute.
4141 (e) The board of regents of the Texas State University
4242 System may acquire, purchase, construct, improve, renovate,
4343 enlarge, or equip property, buildings, structures, facilities,
4444 roads, or related infrastructure for the institute to be financed
4545 by the issuance of bonds in accordance with Subchapter B, Chapter
4646 55. The board of regents may pledge irrevocably to the payment of
4747 those bonds a portion of the proceeds of the fund. The amount of a
4848 pledge made under this subsection may not be reduced or abrogated
4949 while the bonds for which the pledge is made, or bonds issued to
5050 refund those bonds, are outstanding.
5151 (f) The State Board for Educator Certification shall accept
5252 completion of an institute training program by a public school
5353 administrator as meeting, for the year in which the administrator
5454 completes the program, the administrator's continuing education
5555 requirement under rules proposed under Section 21.054.
5656 (g) At the request of a public school administrator who
5757 completes an institute training program, an institution of higher
5858 education identified in Subsection (b) shall award the person up to
5959 12 hours of credit towards a graduate degree in education. A public
6060 school administrator is not entitled to credit under this
6161 subsection at more than one institution of higher education.
6262 (h) The president of Sam Houston State University may
6363 establish rules relating to the institute.
6464 SECTION 2. Not later than January 1, 2010, Sam Houston State
6565 University, in cooperation with the University of North Texas and
6666 Texas State University--San Marcos, shall establish the Public
6767 Education Management Institute of Texas, as required by Section
6868 96.66, Education Code, as added by this Act. Not later than January
6969 1, 2011, the Public Education Management Institute of Texas shall
7070 begin offering training programs to public school administrators.
7171 SECTION 3. This Act takes effect immediately if it receives
7272 a vote of two-thirds of all the members elected to each house, as
7373 provided by Section 39, Article III, Texas Constitution. If this
7474 Act does not receive the vote necessary for immediate effect, this
7575 Act takes effect September 1, 2009.
