| 6 | 6 | | relating to state agency information available on the Internet. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 2054.126(d), Government Code, is amended |
|---|
| 9 | 9 | | by amending Subdivision (6) to read as follows: |
|---|
| 10 | 10 | | (d) Each state agency, other than an institution of higher |
|---|
| 11 | 11 | | education, that receives an aggregate amount of appropriations in |
|---|
| 12 | 12 | | the General Appropriations Act for a state fiscal biennium that |
|---|
| 13 | 13 | | exceeds $175 million shall post the following information during |
|---|
| 14 | 14 | | the biennium on a generally accessible Internet site maintained by |
|---|
| 15 | 15 | | or for the agency: |
|---|
| 16 | 16 | | (6) an electronic link on the agency Internet site's |
|---|
| 17 | 17 | | home page to: |
|---|
| 18 | 18 | | (A) the provisions of the Texas Constitution as |
|---|
| 19 | 19 | | published in the electronic version of the constitution hosted by |
|---|
| 20 | 20 | | the Texas Legislative Council that authorize, govern, control, or |
|---|
| 21 | 21 | | mention the agency or an agency program or project. |
|---|
| 22 | 22 | | (B) the provisions of statutes as published in |
|---|
| 23 | 23 | | the electronic version of state laws hosted by the Texas |
|---|
| 24 | 24 | | Legislative Council that authorize, govern, control, or mention the |
|---|
| 25 | 25 | | agency or an agency program or project. |
|---|
| 26 | 26 | | (C) the agency's rules as published in the |
|---|
| 27 | 27 | | electronic version of the Texas Administrative Code and an |
|---|
| 28 | 28 | | electronic link to any written procedure of the agency relating to |
|---|
| 29 | 29 | | agency hearings that is not contained in the electronic version of |
|---|
| 30 | 30 | | the Texas Administrative Code. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2009. |
